An extension of the residence permit beyond the six-month period of issue is not permissible as long as you have not legally resided in the Federal territory for at least 18 months when the residence permit was first issued.
If you have been legally resident in Germany for at least 18 months, it is possible to extend the residence permit, which is initially limited to six months. The same requirements must be met as for the granting of the residence permit.
An extension of the residence permit is only permissible if you are aiming for a temporary stay. If you are aiming for a permanent residence or a residence in the Federal territory which cannot be foreseen in terms of time, an extension of the residence permit cannot be granted.
You must urgently ensure that you submit an application for an extension or the issue of another residence permit before your residence permit expires. If the application is submitted in good time, i.e. before the expiry of the time limit, the further residence is deemed to be permitted until the decision of the Aliens Department with all subsequent effects (e.g. the entitlement to receive social welfare). A late application (after the end of the period stated in the residence permit) can result in considerable legal disadvantages. Your further stay would then be unauthorised. You are then obliged to leave the country.
- The residence title shall be renewed if the requirements which must have been met when it was first issued continue to be met.
- Existence of an application for extension
- There must be no grounds for refusal.
For the extension of the residence permit of up to three months, a fee of 96 euros is due (48 euros for minors). For the extension of the residence permit for more than three months, a fee of 93 euros is due (46.50 euros for minors).
Exemption from fees when receiving social benefits
As a rule, you must apply for the extension of your residence permit in person - well in advance of the expiry of your residence permit - at your competent aliens' registration office.
Arrange an appointment with your local aliens' registration office. You can also find information about the application procedure and which documents you have to submit in which form on the respective website of the Foreigners' Registration Office.
If you have applied for an extension in due time (before the expiry of your residence permit), your previous residence is considered to be permitted until the decision of the Aliens' Registration Office.
If your application is granted, the Aliens Department will commission the Bundesdruckerei to produce the electronic residence permit (eAT) with a new validity date.
With regard to the duration of the procedure until the residence permit is issued, please obtain information from the competent Aliens' Registration Office.
You will usually be informed of the duration of the procedure (about 6 to 8 weeks) when you apply for an extension by the competent Aliens' Registration Office.
Note: The residence permit is issued as an electronic residence title.
Apply for the extension of your residence permit at your competent aliens' registration office in good time before the expiry of the validity. Please enquire about this at your competent foreigners authority.
If you intend to stay in Germany permanently, the extension of the residence permit for temporary residence cannot be considered.
