If you would like to know whether information on serious violations is stored about you in the National Violation File of the Sea Fisheries Act and you need this information for submission to an authority, you can submit an application for information from the authorities to the BLE.
You can apply to the Federal Agency for Agriculture and Food (BLE) for information on the content of the National Infringement File of the Sea Fisheries Act that concerns you.
Violations of the provisions of the EU Common Fisheries Policy (CFP) are stored electronically in the National Violations File. Infringements committed by German nationals are entered, as are infringements committed on fishing vessels authorized to fly the German flag. Offenses committed while fishing in the territorial sea or the German Exclusive Economic Zone are also documented. In addition, points for serious infringements are entered in the infringement file.
Some federal states in particular have set up support programs for fishing and aquaculture. If you would like to apply for fisheries funding, for example under the European Maritime, Fisheries and Aquaculture Fund (EMFAF), it is generally a prerequisite that you do not have any points for serious infringements entered in the infringement file. In this case, you apply to the BLE for information for submission to an authority (authority information).
It is also possible for your legal representative to apply for information from the authorities.
- Application for information from the authorities
- officially or publicly notarized signature on the application form and/or
- valid identity card
- Application for information from the authorities by legal representative, if applicable
- Proof of authorization for legal representation, if applicable
- Affidavit, if applicable
You can apply for official information from the National Infringement File in writing by post or online.
If you would like to submit the application in writing by post:
- Download the relevant form and complete it.
- You will then have to prove your identity.
- Option 1: Have your signature on the application form officially or publicly notarized. You then send this document to the state authority responsible for you.
- Option 2: Present your identity card, passport or residence permit in person to the competent state authority. The state authority will then forward your signed application to the BLE.
- The BLE will check your application. If the application meets all the requirements, the BLE will issue and send you a fee notice.
- As soon as the fee has been credited to the BLE's account, the information will be sent by post to the authority specified in the application.
If you wish to submit the application electronically, you can use the online service:
- Go to the BLE website and use the link provided for the online procedure. Follow the steps indicated.
- The BLE will check your application. If the application meets all the requirements, the BLE will issue and send you a fee notice. As soon as the fee has been credited to the BLE's account, the information will be sent by post to the authority specified in the application.
If you would like a self-disclosure of the contents of the national infringement file concerning you, you can submit an application for self-disclosure (see National Infringement File in the Sea Fisheries Act; Applying for self-disclosure).
There is no right of appeal against the information from the national infringement file. An appeal may be lodged against the notification of charges.
