You require a permit from the Federal Government for trading and brokering transactions involving war weapons located abroad.
You apply for a license for foreign transactions with war weapons if you
- want to conclude or broker corresponding contracts or
- wish to establish contacts with interested parties and thus demonstrate the opportunity to conclude a contract, for example in the case of brokerage activities.
The licensing requirement applies to brokering, providing evidence of and concluding contracts for the purchase or transfer of war weapons, for example
- purchase contracts,
- rental agreements,
- rental agreements,
- gift agreements,
- contracts for work and services,
- leasing contracts or
- service contracts.
You can also use the same form to apply for manufacturing and transportation in Germany and abroad.
The Federal Ministry of Economics and Climate Protection (BMWK) is responsible for your application. You can also address general questions on war weapons control to Department 222 of the Federal Office of Economics and Export Control (BAFA).
You have no right to the granting of a permit. In particular, this may not be granted if there is reason to assume
- that the granting of the license would run counter to the interests of the Federal Republic of Germany in maintaining good relations with other countries
- that the war weapons will be used in a peace-disturbing act, in particular in a war of aggression
- that the granting of the license would violate the Federal Republic's obligations under international law or jeopardize their fulfillment
Fees are charged for the application. The Special Fees Ordinance of the Federal Ministry of Economics and Climate Protection (BMWK) is used to calculate the fees. For individually attributable public services in the area of responsibility of the BMWK and the Federal Office of Economics and Export Control (BAFA), the BMWK and BAFA Special Fees Ordinance for War Weapons Control, Export Control and Investment Control - BMWKBGebKAIV applies.
You can apply for approval informally online or in writing.
Online application:
- Call up the online application on the federal portal. This will guide you step by step through the necessary information, which you can enter electronically.
- Upload the required documents as a file (in PDF, JPEG, PNG format, maximum 10 megabytes per file) and send the application.
- The licensing authority will check your application and may request further documents or evidence from you.
- You will receive a notice of approval or rejection.
Application by post:
- You submit the application informally.
If you wish to arrange a contract for the purchase or transfer of war weapons or wish to provide evidence of the opportunity to conclude such a contract, your application must contain the following information:
- Name and address of the applicant
- Name and address of those between whom the contract for the acquisition or transfer of war weapons is to be concluded
- Designation of the war weapons
- Number of the war weapons list: Please enter the classification number using the War Weapons List
- Number of items or weight: Enter the exact number of items for each type of weapon; for ammunition, enter the caliber
- Name of the country in which the war weapons are located
If you wish to conclude a contract for the transfer of war weapons, your application must contain the following information:
- Name and address of the applicant
- Name and address of those to whom the weapons of war are to be transferred,
- Designation of the war weapons
- Number of the war weapons list: Please enter the classification number using the War Weapons List
- Number of items or weight: Enter the exact number of items for each type of weapon; for ammunition, enter the caliber
- Name of the country in which the war weapons are located
- The licensing authority will check your application and may request further documents or evidence from you.
- You will receive a notice of approval or rejection.
The following information is available:
You require a different permit if you wish to import war weapons into the federal territory or transport them through the federal territory. In these cases, you must apply for a transport permit.
