The approval of a variety marketed by you or other registered breeders expires? Then you can apply to the Bundessortenamt (BSA) for an extension of the approval.
If the approval of a plant variety marketed by you or other registered breeders expires, any of the registered breeders may apply for an extension of the approval at the Bundessortenamt (BSA). The successful extension will then be registered for all further breeders.
The BSA decides whether an agricultural plant variety will be approved for another 10 years. The approval of vine and fruit varieties can be extended for another 20 years.
- Informal application for renewal of the variety or use of the form on the website of the BSA.
- The BSA has already approved the variety.
- The requirements for registration are met, i.e. the variety is still distinct, uniform and stable.
- The cultivation and market importance justifies an extension or the extension is necessary for the conservation and sustainable use of plant genetic resources.
You can submit your variety approval renewal application to the BSA online, by mail, or by fax.
Online:
- Go to the BSA's website and fill out the application form ("Application for Extension of Variety Approval").
- To be able to use the form, you will need
- your breeder number (will be published in the Plant Variety Bulletin) and
- a password (will be given on request).
- Submit the application online.
By mail or by fax:
- Alternatively, once completed, print, sign, and mail or fax the forms to the BSA.

- Application for renewal must be submitted to the Bundessortenamt (BSA) no later than 2 years prior to the expiry of the variety approval.
- Duration of extension of variety approval:
- further 10 years for agriculturally used plant varieties
- further 20 years for vine and fruit varieties
- In case of refusal of renewal: expiry date for variety no later than June 30 of the 3rd year after expiry of the approval period.
