Would you like to transport waste across national borders as a company? Then the regulations of the EC Regulation on shipments of waste apply to you.
All waste to be disposed of or otherwise recovered and transported across national borders must in principle be notified. The notification procedure allows competent authorities to monitor transboundary shipments of waste. In particular, the export of hazardous waste to countries with low environmental and safety standards should be prevented.
The following must therefore be notified:
- all waste that is disposed of (exception: waste for laboratory analysis, max. 25 kg),
- all waste listed in Annex IV for recovery (so-called yellow list waste);
- all wastes for recovery listed in List A of Part 1 of Annex V (hazardous wastes as defined in Annex VIII to the Basel Convention);
- all waste for recovery or mixtures of waste for recovery not listed as a single entry in Annexes III, IIIA, IIIB, IV or IVA.
Exemptions from the notification obligation can be obtained from the competent authority.
Who must notify?
As a notifier, you are considered a natural or legal person in the country of dispatch if you transport waste yourself or have it transported. As a rule, this is the original waste producer, in order of further mention, also the new producer, an authorised collector, a registered dealer, a registered broker or the holder of the waste.
Notification shall be made through the competent authority of dispatch. To that end, the notifier shall submit to the authority of dispatch all documents necessary for the notification, including the necessary copies for all the authorities involved. The authority of dispatch shall then verify that the notification has been properly executed and, if the assessment is positive, shall send the documents within three working days to the destination authority and to all transit authorities concerned and inform the notifier accordingly. However, the authority of dispatch may refuse to forward the documents if it requests documents or objects to the notification within the three-working day period.
Furthermore, three working days after receipt of the notification documents, all authorities involved shall have the possibility to request additional information and documents if necessary. No later than three working days after receipt of the documents, including those previously requested, the competent authority of destination shall send a so-called acknowledgement of receipt. Even if the notification is properly executed, the authority of dispatch may request further documents necessary for the assessment of consent. It then informs all those affected about this additional demand. However, it is obliged to forward the notification. In this case, the authority of destination may not send an acknowledgement of receipt until it receives notification from the authority of dispatch that these subsequently requested documents have also been received. No later than 30 days after the acknowledgement of receipt has been sent, all the authorities involved shall take their decision on the proposed notification, either conditional consent, conditional consent or objection.
Once all consents to the notification have been obtained, the notifier shall enter the actual date of shipment in the movement document and complete it as far as possible. The notifier shall then send copies of the completed and signed movement document to the competent authorities concerned and to the consignee of the waste at least three working days before the intended shipment. The original movement form and copies of the notification form as well as copies of the consent notices must be carried during transport. The facility shall confirm acceptance of the waste on the movement document no later than three days after receipt and shall send it to the notifier and the competent authorities concerned. No later than 30 days after completion of the disposal and no later than one year after receipt of the waste, the disposal facility shall confirm that disposal to the notifier and the competent authorities concerned by sending them a signed copy of the movement document. If the waste is subjected to the disposal procedure specified in the notification immediately after reception (e.g. within three days) at the disposal facility, reception and disposal may be submitted simultaneously. In this case, the last step as described above is omitted.
You can notify waste at any time. If documents for the procedure are missing or there are objections, the shipping authority will contact you within three working days.
No later than 30 days after the acknowledgement of receipt has been sent, all the authorities involved will give their decision on the planned notification and you will receive the exact date of shipment of the waste.
