§ Section 12 (1) of the Prostitution Protection Act (ProstSchG):
The operation of a prostitution establishment requires a permit from the competent authority. The permit may be limited in time.
The permit must be extended upon application if the conditions relevant to the granting of the permit continue to exist.
§ Section 12 (2) of the Prostitution Protection Act (ProstSchG):
The permit for the operation of a prostitution establishment is granted simultaneously for a specific operating concept and for specific structural facilities, installations and rooms located therein.

If the requirements are met, there is a legal entitlement to the granting of a permit to operate a prostitution business.
For a permit in accordance with Section 12 (1) of the Prostitute Protection Act, the following documents must be attached to the application in accordance with Section 12 (5) of the Prostitute Protection Act:
1. the operating concept,
2. the other documents and information required to
proof that the license requirements have been met and
3. the name, date of birth and address of the person for whom
the permit is being applied for, or in the case of a legal person
its company name, address, number of the register sheet in the commercial register and its registered office.
The licensing authority shall provide information on which additional documents must be submitted.
Legal capacity of the applicant.
In accordance with Sections 14 and 15 ProstSchG, the applicant or the person designated as deputy or management must possess the required reliability.
As a rule, the required reliability is not given if the person fulfills a characteristic listed in Section 15 (1) ProstSchG.
Pursuant to Section 16 (1) ProstSchG, the main characteristics of the business and the precautions taken to comply with the obligations under this Act must be described in the business concept.
§ Section 16(2) ProstSchG lists the key aspects that must be set out in the operating concept.

The granting of a permit requires an application:
- An application must be submitted to the competent authority using the prescribed forms and enclosing the required documents.
- The documents submitted will be checked for completeness and conclusiveness.
- If necessary, additional documents will be requested.
- If necessary, an on-site visit will be arranged.
- A personal meeting is regularly arranged.
- If all requirements are met, the permit will be issued. The applicant receives the permit notification.
Otherwise, a rejection notice will be issued.
