At least 4 weeks before erecting an aviation obstacle for which no building permit is required, apply for an aviation permit from the relevant state aviation authority.
If you erect structures, trees or equipment or create depressions in the ground, the safety of air traffic may be endangered. Therefore, under certain conditions, you will require an air traffic permit from the relevant state aviation authority.
In the case of structures that require a building permit, this permit is issued by the responsible building authority as part of the building permit procedure. For the erection of structures, equipment, trees or depressions in the ground for which you do not require a building permit, submit the application directly to the responsible state aviation authority.
The height limits for the permit requirement are based on the distance of the object from airfields (including heliports or airports) and the height of the object in meters above ground and in meters above sea level. In construction protection areas of airports, there are different height limits from 0.00 meters to 100 meters above ground level as well as different distance radii (inside and outside approach sectors) in relation to the respective airport reference point.
Approval is also required for aviation obstacles outside the construction protection area from a height of 100 meters above ground level or, if applicable, on ground elevations. In the case of aviation obstacles below 100 meters above ground level that are planned in the vicinity of gliding areas or landing sites (e.g. also special helicopter landing sites) without a construction protection area, the state aviation authority must also be contacted to ensure the safety of air traffic. Information on the approval requirement for your project can be obtained from the responsible state aviation authority.
Note:
The Federal Armed Forces Aviation Office in Cologne-Wahn is responsible for aviation obstacles in construction protection areas of military airfields.
Submit the application at least 4 weeks before the start of the project. Please state the type of obstacle, the location (location coordinates in degrees, minutes and seconds in WGS84) and the height in meters above ground level and in meters above sea level of the top of the obstacle as well as the date of installation and, in the case of temporary obstacles, the duration until which the obstacle will be in place.
- Application with details of the type of obstacle, location (geographical coordinates in degrees, minutes and seconds in WGS84), height in meters above ground level and in meters above mean sea level of the top of the obstacle, date of installation and, in the case of temporary obstacles, the duration of their presence
- Sketch/view drawing of the obstacle
- General site plan/topographical map showing the location and extent of the obstacle (e.g. crane location and boom length)
For equipment:
- Data sheet of the equipment to be used (e.g. mobile crane)
For structures:
- Building description
- Approval required due to the location and height of the obstacle
- Approval, if necessary, subject to conditions, e.g. for marking
Find out about the approval requirement for your project, for example from the relevant state aviation authority. Submit the application with the other documents to the responsible state aviation authority.
Once the complete documents have been received, the responsible aviation authority will check within 4 weeks whether the permit can be issued. You will receive the requested permit within 4 weeks or, if applicable, a notification that your application has been rejected.
- Application deadline: 2 months before the start of construction
- Occurrence of a fiction of approval: 2 months after submission of the complete documents, if the aviation authority has not extended the deadline earlier
The State Aviation Authority informs owners of affected properties about the redefinition of construction protection areas at airfields.
- Erection of aviation obstacles
- Approval under aviation law
- Approval of aviation obstacles
- Depending on the location, concerns structural and other installations, overhead lines, equipment, ground depressions and trees
- Application required if no building application necessary
- Specification of the type of obstacle, geographical location coordinates (in degrees, minutes and seconds in WGS84) and height of the top of the obstacle in meters above ground and in meters above mean sea level as well as date of construction and, if applicable, duration of service life
- Different height limits depending on the distance to the airfield (also heliports or airports)
- Responsible: State aviation authority in the Darmstadt and Kassel regional councils
Please contact the state aviation authority responsible for you in the Darmstadt and Kassel regional councils.
Please note:
If the location is in the Darmstadt administrative district, the Darmstadt regional council is responsible. For locations in the administrative districts of Kassel and Gießen, the regional council of Kassel is responsible.
