If you want to operate a restaurant serving alcohol , you are obliged to submit a business registration 6 weeks before the start of operations under the submission of certain documents.

Anyone wishing to operate a restaurant that serves alcohol is obliged to submit a business registration 6 weeks before the start of operations, together with certain documents. This is to ensure that the restaurant is operated by a reliable trader.

Anyone wishing to operate a restaurant without serving alcohol only needs to submit a business registration at the same time as starting the business.

A restaurant is operated by anyone who serves drinks and/or food for consumption on the premises on a commercial basis if the establishment is open to the public or certain groups of people.

No prior business registration is required if alcoholic beverages

  • as a gratuitous ancillary service in small quantities or
  • to house guests in connection with an accommodation establishment

are dispensed. In this case - as in the case of a restaurant that does not serve alcohol - it is sufficient to submit a business license at the time of the start of operations.

The obligation to notify does not exempt you from complying with other trade law regulations, such as closing times, food law regulations, building law (e.g. with regard to the question of toilets).

Kosten

The fee is based on the administrative costs regulation for the business area of the Ministry of Economic Affairs, Energy, Transport and Regional Development (VwKostO-MWEVL). Their amount is calculated according to the time required and amounts to at least EUR 55.00 in the case of a business advertisement for a restaurant serving alcohol if a receipt according to § 2 HGastG in conjunction with § 15 GewO is waived. In addition, there are costs for the documents to be submitted, the amount of which, however, cannot be quantified here.

Temporary operation of a restaurant:

On special occasions, the catering business may be carried out temporarily, if this is done at least 4 weeks before the start of the business, specifying

  • surnames and forenames with addresses capable of being summoned,
  • the place and period during which the restaurant business was carried on,
  • the food and drink to be administered,
  • the expected number of visitors

is notified in writing to the municipality.
