You can apply to the NRW State Office for Nature, Environment and Consumer Protection for notification (approval/notification/recognition) of your testing laboratory for legally regulated tests in the environmental sector. The notification is based on a law or an ordinance and is valid nationwide.

Notification (approval/notification/recognition) of testing bodies (laboratories) for the performance of tests and/or sampling in the legally regulated environmental area.

The prerequisite is the determination of competence, for which you must generally provide proof of accreditation in accordance with DIN EN ISO 17025 by the German accreditation body DAkkS. In exceptional cases, accreditation in accordance with DIN EN ISO 17020 may also be sufficient for special areas (e.g. sampling). Notification can be limited to certain areas of a law or regulation. The basis for uniform notification and competence assessment are the technical modules of the federal state working groups.

Notification is carried out upon application to the competent authority. In NRW, the State Office for Nature, Environment and Consumer Protection is responsible for issuing notifications in the legally regulated environmental sector. The notification is usually limited in time and may be subject to further conditions or restrictions.

Voraussetzungen

The prerequisite for notification is always a competence assessment. In the waste sector, the relevant decrees stipulate that you must submit an accreditation in accordance with DIN EN ISO 17025 from the German accreditation body DAkkS.

Kosten

The notification is subject to a fee. The fees are based on the NRW General Administrative Fee Schedule and are charged according to time spent (tariff item 28.0.1). Tariff item 28.2.3.9 applies to notifications under waste legislation in accordance with the Federal Ordinances, which are included in the Waste module, and tariff item 28.2.3.7 applies to notifications (approvals) in accordance with Section 25 LAbfG.

Verfahrensablauf

There you will also find information on how to submit an application. The application and the list of investigation procedures for the respective legal area are linked on the website. These forms must be completed electronically; they are locked, read-only documents that only allow the required information to be entered.

The application for notification includes a declaration of commitment and consent. Both must be completed, printed out and signed with a legally binding signature. The application and the declaration must be sent to the LANUV by post or fax.

The other attachments to be submitted are listed in the application. These must be submitted by email together with the completed list of investigation procedures. The relevant contact persons and email addresses are published on the Internet. The sender will receive a confirmation of receipt. The submitted documents will be checked for completeness and any missing documents will be requested. This is followed by a review of the technical content. Any queries that arise are usually clarified bilaterally between the person responsible and the applicant. After a successful review, a notification is issued. This usually contains requirements, conditions and time limits (max. five years). If not all areas applied for can be notified, this is usually clarified in advance and the notification is issued for the areas that meet the relevant requirements. If none of the areas meet the requirements, a negative decision may be issued. In this case, however, the applicant can also be asked to withdraw or resubmit the application during the examination phase.

Bearbeitungsdauer

Depending on the legal basis, different deadlines are set for processing. They are between three and six months. This period only begins once all the documents to be submitted have been submitted. Once all the necessary data has been submitted, a processing period of six to twelve weeks is possible, depending on the scope of the investigation requested.

Frist

Notified bodies are advised to submit their follow-up applications six months before the expiry of the time limit if possible.
