If you are a foreign national and wish to marry in Germany, you must present a certificate of no impediment to marriage from your home country.
In this certificate, the competent authority in your home country confirms that there is no legal impediment to your marriage under your home country's law. The purpose of this check is to prevent a marriage being entered into in Germany that is invalid in the home country of the spouses.
If both parties to the marriage have the same nationality, a joint certificate is sufficient. This is also sufficient if the same office in your home country is not locally responsible for you.
If your home country does not issue a certificate of no impediment to marriage or if the certificate issued to you does not meet the legal requirements, you must apply for an exemption from providing a certificate of no impediment to marriage. The President of the Higher Regional Court in whose district the marriage was registered is responsible for this decision. The application for exemption itself is accepted by the registrar when the marriage is registered. In such a case, you must therefore first contact the registry office in your place of residence.
If same-sex couples wish to marry and their home state does not provide for same-sex marriage, a certificate of no impediment to marriage does not have to be submitted.
