§ Section 19 of the Interstate Treaty on Gambling (GlüStV)

As a commercial gaming broker, you are not a retailer, lottery retailer or betting agency. Rather, you broker individual gaming contracts to organizers. You also bring prospective players together to form syndicates and broker their participation in games to an organizer.

If you want to broker games of chance, you need a license to do so. The permit is issued for a limited period and may contain ancillary provisions.

As a commercial gaming broker, you must forward at least two thirds of the amounts you collect to the actual organizer.

• a contract with the organizer of the lottery
• general terms and conditions
• police clearance certificate
• Extract from the commercial register
• Description of the products to be brokered
• Description of how players are to be identified and authenticated
• Proof of connection to the blocking system operated by the federal states
• Proof from the responsible tax office that there are no tax debts

We reserve the right to request further documents.

They may be granted a license for commercial gaming brokerage if:the operation does not conflict with the following legal objectives:

• Prevent gambling and betting addiction
• create the conditions for effectively combating gambling addiction
• counteract unauthorized gambling
• Protect young people and players
• Conduct gambling in an orderly manner
• Prevent crime associated with gambling
• ensure safe and transparent gaming operations
• comply with the following requirements:
  • youth protection requirements
  • Internet ban
  • Advertising restrictions
  • Requirements for information about the risks of addiction
• a social concept is available
• you have the necessary reliability
• you carry out the mediation properly and comprehensibly
• you participate in the suspension system
• the exclusion of banned players is ensured
• the forwarding of two thirds of the amounts collected to the organizer is ensured
• it is ensured that the organizer is informed of the brokerage for each game participation
• an appointed trustee keeps the game receipts and asserts the Organizer's claim to the winnings
• you grant the player the right to inspect his or her own game receipts.

The procedure is as follows:

• If you want to broker lotteries or other games of chance to the organizer of games of chance as a commercial gaming broker, you must have a permit
• If you only want to offer or carry out this activity in NRW, you must submit the application to the Düsseldorf district government. They will tell you exactly which documents you need to submit.
• If you also want to offer or carry out this activity in other federal states, you must submit the application to the responsible gambling supervisory authority in the state of Lower Saxony.
• The application will be reviewed and a decision will then be made.
