§ Section 39 General protection of wild animals and plants; authorization to issue ordinances

If you wish to collect forest products such as mushrooms, berries and herbs commercially, you require a permit from the respective forest owner(s). If these forest products are subject to protection under nature conservation law, you will also need a special permit from the responsible authority.

You must observe and comply with private property rights and the provisions of public law.

You may only carry out the removal in a careful manner. It must not endanger the local population of the species in question and must not significantly impair the ecosystem.

Permission to collect wild plants may be granted if this does not endanger the local population of the species in question and does not have a negative impact on nature.

• A permit from the competent authority is required for the commercial collection of wild plants.
• In the case of forest products, permission must be obtained from the respective forest owner(s)
• If the plants are subject to special protection under nature conservation law, an additional exemption permit from the competent authority is required
