§ Section 10 of the Plant Protection Act (PflSchG)

If you wish to apply plant protection products for others or advise others on plant protection, you must notify the competent authority before commencing your activities.

If your place of business or the areas that you treat or the place where you provide advice are located in another federal state, you must also make a corresponding notification there.

As the farm manager, you must state your name and address or the name and address of your company. If several competent persons in your company apply plant protection products for other companies or act in an advisory capacity, you must state the names and addresses of all these persons. You must also enclose proof of expertise in the use of plant protection products or advice on plant protection for all the competent persons named in the notification.

You must notify the competent authority immediately of any changes to the group of persons and any changes that affect the details of the business as well as the cessation of the business.

Completed notification form and proof of the required plant protection expertise in accordance with the Plant Protection Act for the persons on the farm who use plant protection products for others or who advise on the use of plant protection products.

To ensure that you comply with your notification obligation under the Plant Protection Act in good time, you must

• complete the relevant application form and send it to the competent authority before starting your business.
• enclose with the application form proof of the required plant protection expertise of the persons in the company who use plant protection products for others or who advise on plant protection in accordance with the Plant Protection Act. Since 26.11.2015, only the new certificate of competence in check card format has been valid as a certificate of competence.

You can submit your notification in writing or electronically.

Once you have submitted the application and all documents are complete, the competent authority will check whether all requirements for notification in accordance with the Plant Protection Act have been met.

If all documents are complete, you have fulfilled your obligation to notify in accordance with the Plant Protection Act.

You may only commence your activities once you have fulfilled the obligation to notify in accordance with the Plant Protection Act.

According to the Plant Protection Act, persons who have a certificate of competence in plant protection are obliged to take part in a recognized training course at least once within a three-year period.
