A fine procedure is initiated if a serious administrative offence has been committed. Typical examples are not minor speeding, violation of the 0.5 per mille limit, traffic violations on motorways, etc. Corresponding administrative offences are listed in detail in the catalogue of fines . The catalogue of fines determines standard rates for the amount of the fine and also provides for the imposition of a driving ban for certain infringements.

The fine procedure is more complex than the warning fine procedure. In fine proceedings, the provisions on criminal proceedings apply mutatis mutandis. Fines usually have an amount of at least 40.00 euros. A corresponding final fine notice is always associated with the entry of at least one point in the central traffic register.

After the person concerned has had the opportunity to comment and the facts have been clarified, the authority issues a fine notice. If there are indications that the offence is a criminal offence, the administrative authority shall refer the case to the public prosecutor's office.

Hearing form:

• is always sent to the vehicle owner
• the person concerned is given the opportunity to comment on the allegation of administrative offence
• Driver of the vehicle can be named (e.g. for company cars)

Payment:
In the case of consent to the allegation, there is a payment period of one week.

Legal claim during the hearing:

• no legal claim to a restatement
• The administrative authority may issue a fine without further notification.

Notice of fine:

• Setting of the fine
• Collection of fees, expenses according to the Administrative Offences Act
• The person concerned can lodge an objection within two weeks, otherwise the decision is admonishable and enforceable.

Enforcement:

• in the absence of a reaction: enforcement up to attachment

• in case of timely objection, will be re-examined
