If you wish to marry abroad, there may be a legal standard in the country where you intend to marry which requires the presentation of such a certificate.

A certificate of no impediment to marriage can also be issued in Germany for stateless persons, persons entitled to asylum, recognized refugees and persons whose nationality cannot be determined.

The certificate is issued by the registry office in whose jurisdiction the applicant is domiciled or habitually resident.

The certificate of no impediment to marriage is valid for a period of six months.

• The requirements, type and format of the evidence to be provided and the examination of the marriage requirements are governed by German law, as for a German citizen.
• Proof must be provided in the form of public documents:
  • The civil status.
  • The domicile, habitual residence.
  • Nationality.
  • As well as the last marriages and/or civil partnerships and their dissolution, if applicable.

• If the person wishing to marry abroad has one of the following personal statuses:
• Stateless
• entitled to asylum
• Recognized refugee
• or a person whose nationality cannot be determined,
• and have their habitual residence in Germany.

• Costs may be incurred for the issue of a certificate of no impediment to marriage. Please contact your registry office.

• An application for a certificate of no impediment to marriage is submitted to the relevant registry office.

• If the examination shows that there is no impediment to the intended marriage under German law and the necessary personal details of both parties to the marriage have been provided, the registry office will issue the requested certificate of no impediment.

• Depending on the individual case

Once issued, the certificate of no impediment is valid for a period of six months.

• The registry office can issue a certificate of no impediment to marriage for stateless persons, persons entitled to asylum, recognized refugees and persons whose nationality cannot be determined and whose habitual residence is in Germany.
• The registry office in whose jurisdiction the applicant has their domicile or habitual residence is responsible.

• • The German personal statute applies to these groups of persons
  • And thus the marriage requirements under German law
  • Can apply for a certificate of matrimonial capacity for a marriage abroad.
