As a company, do you want to transport waste across national borders? Then the provisions of the EC Regulation on shipments of waste apply to you.
All waste for disposal and recovery that is to be shipped across national borders must in principle be notified and requires the consent of the authorities involved in the country of dispatch and the country of destination
This consent can be granted below:
- Consent without conditions,
- consent with conditions
- Objection.
Exceptions to the notification requirement can be obtained from the competent authority.
The information and documents to be submitted are listed in Annex II of EU Regulation 1013/2006.
Approval is granted if the notification has been carried out correctly, the documents submitted are complete and no objections have been raised.
After receiving all the necessary documents, the authority of dispatch checks whether the notification has been carried out correctly, sends the documents to the authority of destination and all transit country authorities concerned within three working days if the assessment is positive and informs the notifier accordingly. However, the authority of dispatch may refuse to forward the documents if it requests additional documents or raises an objection to the notification within the period of three working days.
No later than three working days after receipt of the documents, including those previously requested, the competent authority of destination sends a so-called acknowledgement of receipt. Even if the notification is carried out correctly, the authority of dispatch may request further documents necessary for the assessment of the approval. However, it is obliged to forward the notification. In this case, the authority of destination may only send an acknowledgement of receipt once it has received notification from the authority of dispatch that these subsequently requested documents have also been received. No later than 30 days after the acknowledgement of receipt has been sent, all authorities involved shall issue their decision on the planned notification. This is done by
- Consent without conditions or
- Consent with conditions or
- raising an objection.
No later than 30 days after transmission of the acknowledgement of receipt, all authorities involved submit their decision on the planned notification.
"Shipment" means the transportation of waste destined for recovery or disposal which takes place or is intended to take place
(a) between two countries; or
(b) between a country and overseas countries and territories or other territories under the protection of that country; or
c) between a State and a land territory which is not a State under international law, or
d) between a State and Antarctica, or
e) from a State through one of the above-mentioned territories, or
f) within a state through one of the above-mentioned territories and which begins and ends in the same state, or
g) from a geographical area not under the jurisdiction of a State to a State.
