Ausnahmen von der Betriebssicherheitsverordnung beantragen

You are an employer and certain protective measures of the Industrial Safety Ordinance can only be implemented by very high effort and are not proportionate for you? Then there is the possibility to apply for an exception to these.

The following serves to grant exceptions to the protective measures described in the Industrial Safety Ordinance

• in the event of energy hazards ,
• further protective measures,
• on the specifications for the maintenance and modification of work equipment,
• measures to be taken in the event of special operating conditions,
• malfunctions and accidents,
• and on the special requirements for lift installations

Application with the following information

• reason for requesting the exemption, description of disproportionate hardship,
• activities and procedures concerned,
• the number of employees likely to be affected,
• technical and organisational measures to be taken to ensure safety and avoid hazards,
• Expert opinions on the equivalence of the planned technical and organisational measures.

The prerequisite is that the application of these rules would lead to disproportionate hardship for the employer in individual cases.

1. Submission of the application and expert opinion online
2. follow-up act and examination by the authority,
3. This is followed by the exemption notice or rejection of the application

The processing time is 4 weeks after receipt of the complete application documents.
