In principle, conformity assessment procedures must be carried out for products in potentially explosive atmospheres.

The provision, exhibition or first-time use of equipment and protective systems for potentially explosive atmospheres, as well as their components and necessary safety, control and control devices is regulated in the Product Safety Act.

Normally, a conformity assessment procedure must be carried out in accordance with Annexes III to IX of Directive 2014/34/EU (ATEX Directive).

However, the market surveillance authority may, upon duly justified request, authorise the placing on the market or putting into service of products for which no conformity assessment procedure has been carried out, provided that the use of those products is necessary in the interest of protecting humans, domestic animals or property. This rule applies only to the territory of the country concerned and not to components. Applications are usually submitted by (specialist) companies.

Content of the application informally (in writing):

• Description and specification of the product including the planned deviation
• if individual devices, protective systems or devices (custom-made devices) are placed on the market, or
• the modification of equipment, protective systems or devices already placed on the market at the operator's premises by a service provider

Evidence:

• that a conformity assessment procedure under Directive 94/9/EC would entail a disproportionate burden or delay, or that the use of the devices would be in the interest of protecting health and safety, which may be hampered, for example, by the delay resulting from conformity assessment procedures;
• the safety of the products is ensured in another way (e.g. specially trained personnel, acceptance test by a ZÜS).
• that the products to be authorised are limited to the territory of the Member State concerned.

• The safety of the products is ensured in other ways (e.g. specially trained personnel, acceptance test by a ZÜS).
• Use of the requested products only in Germany
• duly substantiated and complete application to the competent authority

In the case of complete application documents, the processing takes place within one month, max. 3 months.
