If you wish to construct or significantly modify a facility for handling substances hazardous to water or take measures that result in a change in the hazard level, you must notify the competent authority.

You must submit your notification of the construction, significant modification or change to the hazard level of an installation subject to mandatory inspection to the competent authority in good time in advance.

The construction of these installations does not have to be notified if

• a suitability assessment has been applied for in accordance with the Water Resources Act for installations for the storage, filling or handling of substances hazardous to water or
• installations are the subject of an approval procedure under other legislation, provided that the approval procedure also ensures compliance with the requirements of the Ordinance on Installations for the Handling of Substances Hazardous to Water (AwSV). In this case, significant changes to the installation that require approval are also not subject to notification.

• Detailed documents describing the project (site plan, drawings, certificates, descriptions)
• Expert opinion, if applicable

The systems must comply with the requirements of the Ordinance on Systems for Handling Substances Hazardous to Water (AwSV). This must be verified with the documents to be submitted.

The costs are calculated according to the time required (from € 57.00 per hour).

If you want to submit the advertisement online:

• You submit the advertisement via the online service.
• You will usually receive a notification confirmation.
• The water authority will check the content requirements, which may result in additional claims.
• The water authority will check your documents for completeness and request any missing information or documents.
• The authority can temporarily or permanently prohibit the project or issue a decision with conditions.
• Your application data will be entered into the authority's specialist procedure.

If you wish to send the notification by letter or e-mail:

• You complete the forms required for the notification and send them to the lower water authority.
• The further procedural steps correspond to the online procedure.

After receiving the notification, the competent authorities have six weeks to carry out a plausibility check and inform the operator of certain additional measures or requirements.

Please send your notification to the competent authority at least six weeks before the start of the measure.

The form for the notification of systems for handling substances hazardous to water in accordance with the Ordinance on Systems for Handling Substances Hazardous to Water (AwSV) is not suitable for heating oil consumer systems and slurry, liquid manure and silage seepage systems (JGS systems).

For this purpose, there are forms adapted to the type of plant. These forms can also be accessed online via the Bürger- und Unternehmensservice Sachsen-Anhalt (BUS). All other types of installations can be displayed using this form.

Contradiction

• Notification of the construction, significant modification or measures involving a change in the hazard level of AwSV installations (except heating oil consumer installations and JGS installations) Acceptance

  • before a significant change is made to the installation
  • before measures that lead to a change in the hazard level of the installation
• The obligation to notify in accordance with Section 40 AwSV only applies to installations subject to inspection in accordance with Section 46 AwSV.
  • The hazard potential of the installation is decisive for the inspection obligation.
  • Underground systems above 0.22 m³ must always be notified.
  • Above-ground systems depending on the location, the substance/mixture handled and the volume.
• The notification form or the online service "Notification of heating oil consumer installations" must be used for the notification of heating oil consumer installations.
• The notification must be received by the competent authority at least 6 weeks in advance.
• The competent authorities in Saxony-Anhalt are the lower water authorities of the districts or independent cities at the location of the system.

The lower water authority of your district or independent city is responsible.
