As the operator of a prostitution business, would you like to employ persons in the areas of management and supervision? Then you must report this to the competent authority if you have a permit in accordance with Section 12 ProstSchG and the authority has instructed you to report this.

If you have a corresponding ancillary provision (conditions) to a permit in accordance with Section 12 Prostitution Protection Act or if the authority requires this of you on the basis of another authorization basis, the following applies:

If you, as the operator of a prostitution business, wish to employ persons in the prostitution business in the following areas of responsibility, you must report this to the competent authority:

• Management and supervision
• Compliance with domiciliary rights or house rules,
• admission control or
• security

All persons employed in the above areas of responsibility must undergo a background check. This also applies if the relevant persons are employed by external companies.

If it is assumed that this person does not have the necessary reliability for their work, the competent authority can issue an employment ban and prohibit you from employing the person or their work in the prostitution trade.

• Surname, first name of the person to be employed
• Certificate of good conduct for submission to an authority according to document type "0", or European certificate of good conduct
• Identity card, passport or residence permit

• Valid permit for the operation of a prostitution business
• the person to be registered must consent to the processing of the background check

Depends on the respective administrative fee schedule of the state or on the fee statutes of the authorities responsible under state law.

You submit the notification of other persons working in the prostitution trade to the competent authority.

The competent authority carries out a background check.

If the check is positive, you can employ the registered person in the prostitution trade.

Other persons working in the prostitution trade must be registered immediately.

There are no indications or special features.

Appeal (appeal may be excluded depending on state law), administrative court action

• As the operator of a prostitution business, you must notify the competent authority of persons you wish to employ in the context of the business (management, operational supervision, compliance with domiciliary rights, admission control or security).
• Please note: This only applies in the case of a corresponding ancillary provision (conditions) to a permit in accordance with § 12 ProstSchG or if the authority can demand this from the citizen on the basis of another authorization.
• The authority then checks the person for reliability and can, if necessary, prohibit employment or refuse or revoke the permit.
• Competence: Responsibility depends on the respective state law
