- § 14 Mutterschutzgesetz (MuSchG) – Zuschuss zum Mutterschaftsgeld
- § 24i Sozialgesetzbuch Fünftes Buch (SGB V) – Mutterschaftsgeld
Women who are not themselves members of a statutory health insurance fund, but who have family or private health insurance or no health insurance at all, receive a one-off maternity allowance for the maternity protection period.
They must be employed or working from home at the start of the protection period. The amount of maternity benefit is a maximum of EUR 210.00.
Employees who are covered by private health insurance or who do not have health insurance receive an employer's allowance amounting to the difference between EUR 13.00 and the average net pay. If the employment relationship has been permissibly terminated during pregnancy or the protection period, the Federal Government finances the subsidy.
In the cases mentioned, payment is made by the Federal Insurance Office. If the employer cannot fulfil his obligation to pay the maternity benefit supplement due to an insolvency event, the women also receive the supplement via the Federal Insurance Office.
Tip: The Federal Social Insurance Office can also advise you by telephone on +49 228 619 0.
- Certificate of the presumed date of delivery by a doctor or midwife
This certificate is issued no earlier than seven weeks before the expected date of birth, i.e. one week before the start of the maternity leave period.
- Birth certificate for maternity assistance - the original if you are privately insured, or a copy stamped by the statutory health insurance fund if you are insured with your family.
Send the birth certificate to the Federal Insurance Office for final processing of your application.
You will receive the birth certificate after the birth announcement at your city or municipal administration (registry office).
- You are not a member of a statutory health insurance fund, but have family or private insurance.
- At the beginning of the six-week protection period before childbirth, you are or were in an employment relationship (including a marginal employment relationship) or a home-based employment relationship.
- You changed from a civil servant relationship to an employment relationship during the protection period (female civil servants should contact their employer).
- Your employment relationship was permissibly terminated by the employer during the pregnancy, i.e. with the consent of the competent authority under Land law (e.g. the State Labour Inspectorate).
- Opening of bankruptcy proceedings by the employer or rejection of the bankruptcy petition for lack of assets.
Caution You are not entitled to maternity benefit if the termination was made by you or the employment relationship ended in accordance with the contract (for example, in the case of a fixed-term employment relationship).
- Submit a written application to the Federal Insurance Office.
- You will need the application for maternity benefit and the form "Bescheinigung des Arbeitgebers zur Berechnung von Mutterschaftsgeld" (employer's certificate for the calculation of maternity benefit) (to be filled out by your employer). The forms together with the information sheet are available for download on the website of the Federal Insurance Office. You can also request the form by telephone or in writing.
- Please return the completed and signed application form with the required documents to the Federal Insurance Office.
