Applying for registration in the Central Register of Provisions (ZVR) at the Federal Chamber of Notaries

The Zentrale Vorsorgeregister (Central Precautionary Register, ZVR) of the Federal Chamber of Notaries is the registration office for private as well as notarial precautionary powers of attorney and care decrees from all over Germany. By registering your health care proxy or your care directive there, you enable the courts to find out via this public register that a health care proxy or a care directive exists for you in the event of a sudden case of health care or care.

From 01.01.2023, doctors will also be able to inspect the register and thus find out whether a patient has a health care proxy and/or a living will, insofar as the information is necessary for making an urgent medical decision. This provides the opportunity to find out the patient's will at an early stage, especially in emergency situations.

If you provided information on this when registering, it is even possible to find out where the original document is via the register.

In the Central Precautionary Register, certain data on the precautionary power of attorney or the care directive are recorded electronically. You can enter the following data in the register:

• Data of the grantor of power of attorney:
  (surname, maiden and first names; sex; date and place of birth; address, etc.)
• Data of the authorised representative:
  (family, birth and first names; date of birth; address; telephone number etc.)
• Date on which the document was drawn up
• Place where the document is kept
• Information on the purpose for which the power of attorney was granted or the care directive was drawn up (e.g. matters of property, health care or other personal matters)
• Information on special instructions and wishes

Attention! The Central Precautionary Register does not hold the original document with the declaration of the health care proxy / care directive. It also does not contain a copy of the document or information about its contents. Since only the original document is valid, please keep it in a safe place.

Revocation or deletion from the ZVR

A change of contact data, a revocation or a deletion may be possible for a fee. It is advisable to register a revocation as opposed to a deletion, as this will alert querying guardianship/caretaker courts to the revocation and prompt them to make further enquiries if a continuing power of attorney is claimed.

Note: In order to revoke your health care proxy, you must notify your authorised representative and request the return of any proxy document that may have been issued. Notification of a revocation to the Central Register of Provisions is not necessary or sufficient to remove the power of attorney.

Note: Registration in the precautionary register does not replace the actual precautionary power of attorney or care directive, which is why it is necessary to prepare or certify these before registration.

The amount of the fee for registration depends, among other things, on whether you register via the Internet or by post. A precise list of the costs as well as sample calculations is provided by the Central Register of Provisions.

To register, either contact the Central Precautionary Register directly or instruct a notary or lawyer to carry out the registration.

Registration directly with the Central Register of Provisions

You can register your health care proxy or care directive by post or via the Internet. The Central Precautionary Register provides the necessary forms as well as instructions for internet registration.

• Carry out the internet registration (private individuals) at the Central Precautionary Register of the Federal Chamber of Notaries (see "Further information").
• If necessary, fill out the additional form PZ in order to be able to enter additional authorised representatives/proposed guardians. There are also extra forms for changes and revocation.
• If you choose the postal route, send the registration forms to the Bundesnotarkammer, Zentrales Vorsorgeregister, Postfach 080151, 10001 Berlin.
• In addition to registration by private individuals, registration by institutional users (for example notaries and lawyers) is also possible, who will then have the registration done for you.

Once the health care proxy or care directive has been drawn up, registration with the Central Register of Health Care Providers is possible at any time.

When you make a new entry, you will receive a personal ZVR card in addition to the confirmation of registration. This documents that you have made an entry in the Central Register of Provisions.

On the back of this card you can:

• Name of the grantor of power of attorney / disposer
• Names and telephone numbers of up to two trusted third parties, make a note of.
