When a child reaches compulsory school age (see §27 Sächsisches Schulgesetz), he or she must be registered at the elementary school in whose school district he or she lives the year before enrollment. Initially, it is irrelevant whether the child will subsequently attend a special needs school or not.
If, at the time of the child's registration, there are indications that suggest a special educational need, the parents or the principal of the receiving elementary school can apply to the responsible branch of the State Office for Schools and Education (Landesamt für Schule und Bildung) for the procedure to determine the special educational need on the basis of the school regulations for special needs schools.
Students whose educational, developmental or learning abilities are impaired to such an extent that there are indications that they have special educational needs are entitled to special educational support in accordance with the Saxon School Act (Sächsisches Schulgesetz).
Decision on the (type of) school
After the procedure to determine the special educational needs, the responsible branch of the State Office for Schools and Education will issue a notification based on an expert assessment of the special educational needs. This notification will contain statements about the focus of the special educational support and the needs. In addition, recommendations are given regarding the special educational offers and the appropriate place of learning, taking into account the parents' wishes.
In the Free State of Saxony, in line the UN Convention on the Rights of Persons with Disabilities, which aims to achieve equal participation for persons with disabilities, the Saxon School Act stipulates two possible options:
- Joint (inclusive) instruction at a regular school (elementary school, high school, grammar school) and/or
- instruction at a special needs school.
The special needs schools may also offer particular support to students in order to enable them to participate professionally and socially.
Students who have been diagnosed as needing special educational support within the framework of the procedure for determining special educational needs in accordance with §13 of the Schulordnung Förderschulen can be taught together with non-disabled students in a regular school if the requirements of § 4c Abs. 5 Sächsisches Schulgesetz are met.
A distinction is made between instruction with the same learning objectives and instruction with different learning objectives.
Instruction with the same learning objectives is possible in the special needs areas of hearing, vision, language, physical and motor development as well as emotional and social development. Students are taught according to the curricula of the respective type of school (elementary school, high school or grammar school). This presupposes that the appropriate conditions are met by the school. This means, for example, special visual aids for visually impaired children and adolescents or technical hearing aids for students with hearing impairments.
Children and adolescents with special educational needs in the areas of learning or mental development will be taught according to separate curricula with different learning objectives. For example, students with cognitive disabilities or significant learning impairments are taught according to the curricula of a school with a special educational support focus on mental development or learning, respectively, while the other children or adolescents in the class are taught according to the regular curricula of an elementary or secondary school.
Change of school
If the development of a student during attendance at a special needs school or during inclusive instruction indicates that special educational support with a different focus would be more suitable, the State Office for Schools and Education commissions an educational support report. The report determines the type of school and the school which are better suited to meet the student's individual special educational needs in the future.

For registration at the elementary school:

The following data will be processed:
- Surname and first name of parents and child
- Date and place of birth of the child
- Gender of the child
- Address of parents and child
- Telephone number, contact address in cases of emergency
- Nationality of the child (with the consent of the parents)
- Religious affiliation of the child (with the consent of the parents)
- Type and degree of disability as well as chronic illnesses, if they are relevant for school attendance (with the parents' consent)
- Information on whether a kindergarten will be attended in the year prior to school admission
- Declaration on custody; in the case of sole custody of one parent, this circumstance must be proven
- Declaration by the parents on the child's bilingualism/multilingualism, if the child's native language is not or not exclusively German (with the parents' consent)
For enrollment at a special needs school:
- Notification from the responsible branch of the State Office for Schools and Education determining the child's special educational needs
If a child has not yet attended a school, i.e. if he or she is just about to start school, he or she must first be registered at an elementary school.
Two prerequisites must be met for admission to a special needs school:
Compulsory school attendance
Your child must be of compulsory school age for the school year beginning on August 1. This is the case if he or she has his or her sixth birthday in the period from July 1 of the previous year to June 30 of the year of enrollment. Exceptions are made for children
- who have their sixth birthday by September 30 of the year of enrollment and the parents wish to enroll them in school (no official permission required) or
- whose early enrollment or deferral from school attendance has been officially approved.
Special educational needs or individual request
As a rule, the State Office for Schools and Education has to determine a child's individual special educational needs in an official notification. This is preceded by a procedure in which the parents are also involved. The most suitable type of special needs school for the child is recommended if inclusive instruction at a regular school is not an option.
In individual cases and under certain conditions, attendance at the special needs school is also possible if no special educational needs have been determined.

- All children starting school must be registered by their parents at the elementary school.
- This registration is mandatory, regardless of whether or not attendance at a special needs school is possible.
- The registration process is organized by the schools themselves.

Note: This task must be performed jointly by both parents, provided they have joint custody. If one of the partners is unable to attend, a power of attorney and a copy of the absent parent's ID must be provided.
- If, on the basis of available documents (e.g. the result of the school entrance examination), the elementary school decides that there is a need for counseling and the determination of a child's special educational needs, a counseling interview takes place.
- In this interview, all details are discussed and the subsequent steps are explained.
- Based on the procedure for determining special educational needs, the State Office for Schools and Education issues a notification on the special educational needs and advises on the options for the child's schooling.
- You need this notification to register your child at a special needs school or, in the case of inclusive instruction, at a regular school. You can also register your child at a suitable non-governmental special needs school that has been officially approved as a substitute school.
- The school management decides on admission within the limits of the available places.

Note: Dates for school enrollment are announced in different ways. Some elementary schools send invitations to parents whose children live in their school district. In other communities, dates are announced through a public notice or in the newspaper. When in doubt, it is a good idea to personally contact the elementary school in question.
