Parties can submit nominations. If the parties are not represented in a Land parliament or in the Bundestag with at least five members, they must first notify the Federal Returning Officer in writing that they will take part in the election.

Parties can submit nominations. If the parties are not represented in a Land parliament or in the Bundestag with at least five members, they must first notify the Federal Returning Officer in writing that they will take part in the election.

Erforderliche Unterlagen

The notification of participation in the election must include

  • the name and abbreviation under which the party will participate in the election and
  • the handwritten signatures of at least three members of the federal executive committee, including the chairman or his deputy - if there is no federal executive committee, the signatures of the executive committee of the respective highest party organisation

The following documents must be attached to the application:

  • the written statutes and the written programme of the parties
  • proof of the appointment of the executive committee in accordance with the statutes

Please note! All information and documents must be complete. After expiry of the notification deadline, only deficiencies in valid notifications can be rectified.

Voraussetzungen

The notification of participation is required if the party has not been represented in the German Bundestag or in a Land parliament by at least five deputies without interruption on the basis of its own nominations by the 97th day before the election.

Verfahrensablauf

Submission

  • The party declares in writing that it will participate in the election and submits the required documents in full.
  • The Federal Returning Officer notes the date of receipt on each notification of participation and immediately checks whether it fulfils the requirements of the law (preliminary examination).

Defects

  • If the Federal Returning Officer discovers deficiencies, he shall immediately notify the party executive committee and request it to rectify the deficiencies in good time.
  • After the decision of the Federal Electoral Committee on the determination of party status, any rectification of defects is excluded.

Examination and authorisation

  • The Federal Returning Officer shall invite the parties that have notified their participation in the election to the meeting at which a decision is taken on their recognition as a party for the election. He submits the notifications of participation to the Federal Electoral Committee and reports on the result of the preliminary examination.
  • Before the resolution is passed, the parties involved shall be given the opportunity to comment.
  • The Federal Electoral Committee determines with binding effect for all electoral bodies
    • which parties are represented in parliament with at least five deputies and
    • which associations that have notified their participation are to be recognised as parties for the election.

Announcement

  • Following the determination, the Federal Returning Officer announces the decision of the Federal Electoral Committee at the meeting and briefly states the reasons. The decision is made public.

Rechtsbehelf

  • the party concerned may lodge an appeal with the Federal Constitutional Court against a decision of the Federal Electoral Committee that prevents a party or association from submitting nominations within four days of notification.
  • In this case, the party or association is to be treated by the electoral bodies as a party entitled to submit nominations until a decision is made by the Federal Constitutional Court - at the latest until the end of the 59th day before the election.
