Recognition as a producer organization under the Agricultural Market Structure Act (AgrarMSG)

An association of producers of agricultural products can be recognized upon application by the Saxon State Office for the Environment, Agriculture and Geology as a producer organization under the Agricultural Market Structure Act (AgrarMSG).

Producer organizations and other agricultural organizations (association of producer organizations and inter-branch association) within the meaning of this Act are associations of producers of certain agricultural primary products or processed products ("Annex I" products of the TFEU), which jointly pursue the purpose of adapting production and sales to the requirements of the market.

Details on the legal requirements for recognition and a list of products for which producer groups can be formed and recognized can be found in the Agricultural Market Structure Act (see "Legal basis").

For this procedure, you can use the service of the Single Point of Contact (Einheitlicher Ansprechpartner). They will guide you through the administrative procedure, take care of correspondence with all the offices responsible for your request and will be available to you as a competent advisor.

• Proof of incorporation or merger agreement (certified copy)
• Proof of legal form
• current list of members with names and addresses and proof that they are "active" producers (e.g. supply contract)
• Names and addresses of the authorized representatives (board of directors)
• Name and address of the managing director
• Articles of association (copy)

A producer organization is recognized if it meets the following requirements, among others:

• legal entity under private law (for example: w.V., GmbH, eG, AG)
• at least five founding members (agricultural producers)

Further requirements

• Separate recognition is required for each product area in which a producer organization operates
• The members are obliged to have at least 90% of their agricultural products intended for sale, which are the subject of the producer organization's activities, offered for sale by the organization (obligation to tender).

Exceptions to the obligation to sell are possible by a decision of the producer organization with a two-thirds majority.

• The statutes of the producer organizations must contain regulations on membership fees and sanctions for violations, among other things.

In addition, associations of producer organizations and interbranch organizations may also be recognized.

Procedural fee: usually EUR 180.00 - EUR 700.00 (depending on processing time)

• Select legal form
  • In the case of a GmbH, e. G., AG or similar - application to the competent registration court and entry in the commercial register.
  • For w. V., e. V. - application to the Saxony state directorate
• Formulate written application (informal)

• award as a state-recognized producer organization in accordance with the Agricultural Market Structure Act (AgrarMSG) for which a fee is charged
• annual review of the recognition requirements by the competent authority

Promotion

Producer organizations and their associations are supported if they are recognized by the Saxon State Office for Environment, Agriculture and Geology (Sächsisches Landesamt für Umwelt, Landwirtschaft und Geologie).

They receive start-up aid for the first five years after foundation. For initial investments, investment aid is paid in the first seven years after recognition. Applications for start-up aid and investment aid can be submitted to the Sächsische Aufbaubank - Förderbank - (SAB).
