Application for authorisation wo work on sundays and public holidays in accordance with section 13 para. 3 no. 2 Arbeitszeitgesetz (ArbZG)
In Germany, the Arbeitszeitgesetz (ArbZG) generally provides for rest on Sundays and public holidays. Exceptions, such as for emergency and rescue services, hospitals, buses and trains, are stipulated by law (see Section 10 ArbZG). In addition, the Landesdirektion Sachsen may, under certain conditions, authorise the employment of workers on Sundays and public holidays upon application in accordance with Section 13 (3) No. 2 ArbZG.
This is possible if the work cannot be carried out on working days (including Saturdays) and the work on Sundays and public holidays cannot be avoided by other reasonable alternative measures.
Please note: Even if you are authorised to work on Sundays and public holidays, you must observe special features and restrictions, such as collective agreements, regulations on breaks and rest periods or provisions on maternity protection. A substitute rest day must be granted for work on Sundays and public holidays.
Applications for the suspension of Sunday and public holiday rest can be authorised by the Landesdirektion Sachsen
- in the commercial sector on up to ten Sundays and public holidays per year on which special circumstances make extended business operations necessary (Section 13 (3) No. 2a ArbZG),
- on up to five Sundays and public holidays per year if special circumstances make this necessary to prevent disproportionate damage (Section 13 (3) No. 2b ArbZG), and
- on one Sunday per year to carry out a statutory inventory (Section 13 (3) No. 2c ArbZG).

- Set out the relevant reasons as specifically as possible (see the notes on the application).
In particular, you must explain conclusively and plausibly why the work to be carried out on Sundays and public holidays cannot be carried out on working days (including Saturdays) and that all other reasonable measures to avoid working on Sundays and public holidays have already been exhausted.
