An entry in the debtor register is deleted prematurely if the debtor proves to the central enforcement court that the creditor's claim has been settled in full.
Even if the requirements for the entry order are not (or no longer) met for other reasons, the enforcement court must decide on early cancellation.
- If cancellation is to be requested because the creditor has been satisfied in full, this must be proven by means of suitable documents. It should be noted that the central enforcement court does not have the amount of the claim or details of the creditor.
- It is therefore not sufficient to submit a receipt or proof of payment alone to prove full satisfaction.
- It is also important to ensure that the registration order that is to be cancelled is precisely specified in the application.
You can apply for early deletion from the debtor register informally at the central enforcement court ("competent authority") or at any local court.
