Announcements of external inspection bodies in accordance with Section 11 of the Commercial Waste Ordinance (GewAbfV)
If commercial municipal waste and waste from private households is pre-treated in a facility, the operator* is obliged to have an external inspection carried out for each calendar year within two months of the end of the year.
The regular inspection ensures that the requirements of the Commercial Waste Ordinance (GewAbfV) regarding sorting and recycling quotas and the documentation of incoming and outgoing deliveries of waste are met. The inspections must be carried out by an inspection body appointed by the competent authority.
The obligation to submit an application does not apply if equivalent recognition (notification) from another EU country is presented. This recognition must be submitted before commencing work. At the request of the competent authority, the documents must be submitted with a notarised translation.

Expertise
proof of the expertise of the persons nominated by the applicant by means of
- examination certificates
- diplomas
- courses and training events attended
- previous inspections
- references
- expertise in the field of waste management/waste technology
or through
- accreditation by the national accreditation body,
- certificate as an environmental verifier or environmental verifier organisation or
- (for foreign applicants) public appointment in accordance with Section 36 of the Trade, Commerce and Industry Regulation Act
Independence
- independence is given if no economic, financial or other pressure influences the judgement or the trust in the impartial execution of tasks is called into question.
Reliability
- certificates of good conduct for all company owners or managing directors
- certificates of good conduct for those persons nominated by the applicant who are to carry out the external inspections on their own responsibility
- information from the central trade register for all company owners or managing directors and for the company
- information from the central trade register for those persons nominated by the applicant who wish to carry out the external checks on their own responsibility
in the case of applicants from other EU countries, equivalent foreign certificates are also sufficient in addition to the aforementioned certificates of expertise and reliability if these certificates show that the requirements are met.
Technical equipment:
- a list of the equipment (hardware) required to carry out the on-site inspection and the subsequent written elaboration must be submitted. The technical equipment should be suitable for checking the requirements according to §§ 6 and 10 GewAbfV.
Note: The police clearance certificates must not be older than three months and must be submitted in the original.
You must apply for notification as a third-party inspector in writing; no special written form is required.
- Compile the necessary evidence and declarations.
- Submit the signed application with the required documents to the responsible department.
- After examination by the responsible department, you will receive a written decision as to whether the notification as a third-party inspector has been made.
Note: The notification can be subject to revocation, a time limit, conditions, requirements and the reservation of requirements.
