If you, as a specialist in forensic medicine or pathology, have carried out a second post-mortem examination, you must send the report of the results to the competent health authority.
A second post-mortem examination must be carried out by you shortly before the cremation of a corpse in the crematorium or the passing on of the corpse as a body donor for anatomy. They check whether the circumstances of death correspond to the data given on the confidential part of the death certificate during the medical post-mortem examination. The purpose of the second post-mortem examination is to establish beyond doubt that the death was natural.
A second post-mortem examination shall be carried out at the instigation of the competent public health authority
- to obtain a declaration of no objection from the competent health authority for a cremation,
- when transferring a corpse for cremation to another federal state of the Federal Republic of Germany (unless a second post-mortem examination is also required by law in the respective federal state) or abroad,
- for the purpose of using the corpse for scientific purposes (body donor for anatomy) in an institute for anatomy in the Free State of Saxony, in another federal state of the Federal Republic of Germany or abroad
The report on the results must clearly show whether
- the post-mortem examination revealed indications pointing to a non-natural death,
- the manner of death is still unclear after the post-mortem examination,
- an internal post-mortem examination (autopsy) can be expected to clarify the matter.
The competent public health authority checks the report of the second post-mortem examination for conclusiveness and completeness and, if necessary, requires you to make additions. If the requirements for harmlessness are met, the competent health authority declares harmlessness.
- Arrangement/commissioning of the second post-mortem examination by the competent public health authority
- Work as a specialist in forensic medicine or as a specialist in pathology with experience in post-mortem examination
- Document the result of the second post-mortem examination in the form of notes on a separate sheet as an appendix to sheet 3 of the confidential part of the death certificate.
- Send the documents to the competent public health department. If available for your locality, you can send the report online (see -> Online application and forms)
- The competent public health authority checks the report of the second post-mortem examination for conclusiveness and completeness and requests supplements from you if necessary.
- If the relevant requirements are met, the health authority will declare that the body is safe for cremation or donation.
