If you lease a plot of land primarily for agricultural use, you must conclude a land lease agreement. You must notify the agricultural authority of the conclusion and amendment of lease agreements for areas larger than 0.5 hectares. The purpose of this regulation is to prevent unfavourable contractual arrangements from leading to undesirable agricultural developments.
A new contract already arises when one or more parties to the contract change.
Contract amendments are changes to the leased property (example: land), the lease term or contractual services (example: rent).
- concluded or existing lease agreement for an area predominantly used for agricultural purposes (with or without residential and farm buildings / business)
Lease agreements are exempt from the obligation to notify
- for areas of up to 0.5 hectares,
- between spouses, relatives and in-laws or
- which were concluded as part of an officially managed procedure (e.g. land reorganisation).
Depending on the agreement, the notification is made by you as the lessor/lessee or person procuring the property.
- Inform the responsible department of the conclusion of the contract or the changes in good time and submit the relevant documents.

Within the legally stipulated period, the competent lower Landwirtschaftsbehörde has the option of issuing a notice of objection to the land lease agreement if the contract design is likely to lead to undesirable developments in terms of agricultural structure.
- Notification: within one month of conclusion or amendment of the contract
- Complaint by the authority: in writing within one month of receipt of the notification
