§ 22 Absatz 2 Pflanzenschutzgesetz (PflSchG)
If you want to use a plant protection product in an area of application for which there is no authorisation, you can apply for this on a case-by-case basis to the competent Land authority. The authorisation is only granted to professional users in agricultural or forestry as well as horticultural businesses.
Plant protection products may only be used in the areas of application specified in the authorisation and stated in the instructions for use. For small crops, there are usually only a few authorised plant protection products. This is why gaps in control occur. For further necessary applications, the farm or the user can submit an application for approval on a case-by-case basis.
Collective applications are possible if they are made by legal entities, for example associations, whose members are users.
Authorisation may not be granted for the treatment of seed, unless the treated seed is to be used exclusively on the farm.
- The plant protection product is authorised.
- The plants are only grown on a small scale or
- the harmful organisms to be controlled cause significant damage only in certain areas.
- The application is made for commercial purposes or in the context of other economic undertakings.
- The plant protection product is used on an agricultural or forestry holding or on a horticultural holding.
