If contracts with the water industry are concluded, amended or supplemented, this must be reported to the Landeskartellbehörde.

According to the Gesetz gegen Wettbewerbsbeschränkungen (GWB), concession, demarcation and interconnection agreements in the water industry are only effective after full notification to the competent Kartellbehörde. This also applies to contract amendments and supplements.

If these agreements end or are cancelled, the competent Kartellbehörde must also be notified.

The contracting parties, i.e. the companies involved in the agreement (water supply companies or cities and municipalities or special-purpose associations), are required to notify the authority

• via their respective authorised representative bodies,
• in the case of regional authorities, via the mayor, the district administrator or the chairman of the association.

Registration by one contracting party is sufficient.

• Company or other name
• Place of establishment and registered office (of all companies involved)
• Legal form and address
• Name and address of the appointed authorised representative or other authorised person, in the case of legal entities that of the person legally representing them

Contractual relationships subject to notification

The obligation to notify under the Gesetz gegen Wettbewerbsbeschränkungen (GWB) exists if

• companies in the water supply industry commit to each other or such a company commits to a local authority to refrain from supplying water to the public via fixed pipes in a certain area (area protection or demarcation agreement),
• a territorial authority undertakes to authorise the laying and operation of pipes on or under public roads for an existing or intended supply of drinking water in the territory of the territorial authority exclusively to a specific water supply company (water concession agreement) or
• an agreement is concluded between several companies in the water supply industry, insofar as their purpose is to ensure that certain supply services are made available exclusively to one or more supply companies for the provision of public supply (interconnection agreement).

• Fee range (depending on expenditure): up to EUR 5,000

As an authorised representative of one of the contracting parties, you shall notify the Landeskartellbehörde of the Free State of Saxony (competent authority) of any contract conclusions, amendments or supplements.

• You can submit your notification in full via the online service of the Free State of Saxony (in cooperation with the North Rhine-Westphalia Economic Service Portal): "Wasserwirtschaft online (Sachsen)" (see –> Onlineantrag).
• Alternatively, submit the notifications with the complete documents in writing to the competent authority.

The Landeskartellbehörde will examine the notified agreement with regard to its conformity with antitrust law. You will receive a written decision.

Termination / cancellation

The notification of the termination or cancellation of the contractual relationship with the supporting documents must be sent to the responsible office via the online service of the Free State of Saxony (in cooperation with the Wirtschafts-Service-Portal of North Rhine-Westphalia) "Wasserwirtschaft online (Sachsen)" or in writing.

Registration: immediately after conclusion, amendment or supplementation of the contract.
