Lotteries are characterized by the fact that only cash prizes are raffled off. In contrast, non-cash prizes or non-cash and cash prizes are drawn in lotteries.

Small lotteries exist if the planned playing capital (number of planned tickets x ticket price) does not exceed EUR 40,000.

Small lotteries can be permitted in two ways. Either the competent authority issues a formal permit for the specific individual case or a so-called general permit has already been issued in the form of a general ruling.

In this case, a permit is not required for a lottery or lottery game with a stake of up to 10,000 euros. In this case, you must notify the competent authority of the lottery or draw in good time before the start of the event.

If the planned small lottery is not covered by a general permit, an application must be submitted to the competent authority.

If your planned small lottery is not covered by a general license, an application must be submitted to the competent authority. This must contain at least the following information:

The application must be accompanied by a current notice of exemption from corporation tax in accordance with Section 5 (1) No. 9 KStG with recognition of non-profit status, which can be obtained from the local tax office.

Due to the lower risk potential of lotteries and gambling under Section 3 GlüStV 2021, compliance with the requirements of Sections 6 and 7 GlüStV 2021 is not mandatory. Please note, however, that the final decision on the submission of relevant documents is the responsibility of the competent authority (Section 12 (2) GlüStV 2021

• In principle, they must be non-profit, charitable or ecclesiastically active and therefore exempt from paying corporation tax. The applicant (organizer) must therefore meet the requirements of Section 5 (1) No. 9 of the German Corporation Tax Act (KStG), i.e. it must be a corporation, association of persons or estate which, according to its articles of association, foundation deed or other constitution and according to its actual management, serves exclusively and directly charitable, benevolent or ecclesiastical purposes and is therefore exempt from corporation tax. Private individuals and tradespeople are excluded as organizers.
• No commercial purposes may be pursued with the event.
• The net income of the organizer, the winnings of the players and the costs of the small lottery must be in reasonable proportion to each other. Net proceeds and total winnings must each amount to at least 25% of the prize money; sponsored prizes must be taken into account at an estimated value when determining the total winnings if their actual value is not known.
• The net proceeds must be used promptly for charitable, benevolent or ecclesiastical purposes.

• If a general permit has been issued, a permit is not required for a lottery or lottery game with a gaming capital of up to EUR 10,000. The lottery or gambling must be reported to the competent authority in good time.
• Competent authority: There are four possible competent authorities (depending on the gaming capital):
  • Gaming capital up to 10,000 euros and event within a municipality: Municipality in which the lottery/gambling is organized
  • Gaming capital of more than 10,000 euros up to 40,000 euros and event within a municipality: Saarbrücken district or regional association (excluding the state capital Saarbrücken). If the event takes place within the state capital of Saarbrücken, this is the competent authority
  • Gambling capital up to 40,000 euros and event crossing municipal boundaries, but still within a district, the regional association of Saarbrücken or the state capital of Saarbrücken: district or regional association of Saarbrücken (excluding the state capital of Saarbrücken). If the event takes place within the state capital of Saarbrücken, the latter is the competent authority

If the event takes place beyond the boundaries of a district, the regional association of Saarbrücken (excluding the state capital of Saarbrücken) or the state capital of Saarbrücken or if the gaming capital exceeds 40,000 euros: Saarland State Administration Office

There is no deadline. If a small lottery or lottery game is generally permitted, the competent authority must be notified in good time.

If an individual permit is required for a small lottery or lottery game, it must be submitted in good time to allow the competent authority sufficient time to review the application. No lottery tickets may be sold before a permit has been issued
