A popular initiative is the first stage of a referendum procedure in Schleswig-Holstein. Citizens of Schleswig-Holstein have the right to refer certain matters of political decision-making to the state parliament within the scope of its decision-making competence. In principle, motions on state policy issues or drafted and substantiated bills for which the state parliament is responsible are admissible.
The representatives of an intended popular initiative can obtain advice free of charge from the Ministry of the Interior. In this way, questions about the constitutional and procedural requirements for admissibility can be clarified before the collection of signatures begins. The advice is not legally binding. It is always subject to the proviso that only the Landtag decides on the admissibility of a popular initiative.
Representatives of a popular initiative must be entitled to participate in a popular initiative. All Germans within the meaning of Article 116 (1) of the Basic Law who are eligible to vote in state parliamentary elections are entitled to this right. § Section 5 of the State Election Act applies accordingly. In addition, the representatives must have reached the age of 18.
