If you would like to work as an expert in the mining sector, you will need official recognition under certain conditions. To do this, you must submit an application to the relevant mining authority.
In the mining sector, officially recognized experts can carry out the inspection and approval of certain equipment and activities. If you wish to carry out such expert activities, you must apply for official recognition.
However, the competent mining authority can limit your recognition in terms of subject matter, set a time limit and impose conditions.
- Proof of specialist knowledge, for example by means of a certificate of completion
- for proof of personal reliability:
- If resident in Germany: Certificate of good conduct (not older than 3 months at the time of application)
- If you live abroad: documents from your home country that prove your personal reliability
- Proof of specific professional qualifications for the technical inspections to be carried out, in particular knowledge of
- the state of the art
- the technical regulations and
- the relevant legal regulations
- Proof that you carry out the work on your own responsibility and independently of the employer, client and third parties, for example
- Declaration from your employer that you are in active employment and are free from instructions from superiors or your employer when carrying out your testing activities
- Proof of liability insurance (personal injury, property damage and financial loss)
- Proof of regular participation in further training and subject-related exchange of experience, e.g. certificates, diplomas, certificates of attendance
- You must meet the following criteria:
- There are no known facts that make you appear unreliable to act as an expert.
- You are mentally and physically suitable for the intended expert activity. Under certain circumstances, the competent authority will conduct an examination or an expert discussion with suitable experts to verify your statements in this regard.
- You are professionally competent, i.e:
- You have passed a professionally relevant final examination recognized in the European Union or the European Economic Area at a university, technical university, technical college or technical school, or
- You have acquired comparable above-average specialist knowledge in another way, in particular through relevant vocational training recognized as equivalent, and
- You have the special technical qualification for the specific activities to be carried out, including knowledge of the relevant technical rules and the relevant legal regulations, as a rule demonstrated by at least five years of practical experience in the relevant specialist field. Under certain circumstances, the competent authority may carry out an examination or a technical discussion with suitable experts in order to verify your statements in this regard.
- You have the necessary facilities and, where appropriate, suitably qualified and experienced staff.
- You must ensure that you and your employees work impartially and independently and comply with the obligations for recognized experts.
- If you are in an employment or service relationship, you must also prove that
- your contract of employment complies with the above requirements and that you are able to carry out your expert activities personally,
- you are not bound by any instructions in your expert activities and can sign your work results yourself and
- your place of work releases you to the extent necessary for your expert activities.
- You must have liability insurance for your expert activities.
- The amount and scope of the liability insurance must correspond to the risks of your expert activity. If the liability insurance only partially covers the risks, additional security may be required to cover the uncovered risks.
- If you are based in another member state of the European Union or another state party to the Agreement on the European Economic Area, liability insurance may also be taken out with an insurance company from this EU/EEA state.
You can apply for recognition online via the "BergPass" platform or directly from your local mountain authority.
Apply for recognition online:
- Go to the "BergPass" online platform and register.
- To register, you will need a BundID and an identity card or residence permit with an active online ID function.
- Call up the application form and fill it out completely and truthfully.
- Upload the required documents as a file and send the application.
Apply for recognition directly to the competent authority:
- Contact your competent mining authority and coordinate the required application documents.
- Submit the application and all required documents by post.
Further procedural steps:
- The competent authority will check your application and the documents submitted. If any documents are missing, they will contact you.
- You will receive a notification informing you of the decision on your application. In addition, the decision will be sent electronically to the relevant mailbox (BundID or ELSTER company account) in advance and information will be displayed in BergPass.
You will also receive a notification of costs. Pay the fees.
There is no deadline.
