Anyone who cannot afford the costs of legal advice outside of court proceedings can apply for legal aid.
Legal advice and legal proceedings are subject to a fee. Anyone who is unable to raise the necessary funds for personal and financial reasons has the option of applying for legal aid or legal aid.
Advice assistance is granted on application under certain conditions for the exercise of rights outside of court proceedings. It can be granted in the following areas of law
- Civil law (for example tenancy law, traffic accidents, family law),
- administrative law,
- constitutional law,
- criminal law, misdemeanor law and
- labor and social law.
Alternatively, the person seeking legal assistance can consult a lawyer directly, describe their personal and financial circumstances and request legal aid. The lawyer can then subsequently submit the application for legal aid in writing to the local court.
Legal aid is granted on application for the exercise of rights in court proceedings.
Requirements for legal aid:
- the person seeking legal advice cannot afford the funds required for legal advice according to their personal and financial circumstances,
- there are no other options available for assistance that the person seeking legal assistance can reasonably be expected to make use of, and
- the assertion of rights is not wanton.
Requirements for legal aid:
- the applicant is unable to raise the funds required to conduct the proceedings in accordance with his or her financial and personal circumstances,
- the intended legal defense or prosecution has sufficient prospect of success and
- the intended legal defense or prosecution is not frivolous.
- The person seeking legal assistance must submit an application for legal aid.
- The application can be submitted to the legal application office of the competent local court.
- As part of the application, a formal declaration of personal and financial circumstances must be submitted. This is used to check whether the requirements for claiming legal aid are met.
- If the legal requirements are met, the local court will issue an advice assistance certificate.
- The person seeking legal assistance can use the advice assistance certificate issued to contact a lawyer of their choice and receive free legal advice.
