In exceptional cases, you may be exempted from the obligation to wear a seatbelt or helmet at your own risk.

In order to protect road users, the legislator has stipulated that seat belts must be worn while driving and that safety helmets must be worn when driving motorcycles.

However, it is possible to be exempted from this obligation on request. The resulting considerable safety risk is borne by the applicant.

You can be exempted from the obligation to wear a seat belt

• if it is not possible to wear a seat belt for health reasons or
• if your height is less than 150 cm.

You can be exempted from the obligation to wear a helmet if it is not possible to wear a safety helmet for health reasons.

The exemption is revocable and usually granted for a limited period of time, unless it is a certified/documented permanent condition.

If the requirements for an exemption are of a medical nature, a medical certificate must be submitted stating that the exemption to be applied for is absolutely necessary for medical reasons. The certificate does not need to contain a diagnosis.

A medical certificate or an official document must also be submitted as proof of height under 150 cm.

The decision can be made free of charge for physically disabled persons.

Otherwise, a fee of at least EUR 10.20 is charged in accordance with the scale of fees for road traffic measures.
