Litter is carelessly, and often deliberately, disposed of in the open countryside. Due to its nature or composition, this garbage can endanger soil, groundwater, bodies of water or even the air.

If you would like to report "wild garbage", contact the lower waste authority in your city or county.

Wild garbage" is waste that is illegally deposited in the open countryside, in forests or along streams as well as in public places outside the designated waste containers.

This can be, for example, household and bulky waste, construction waste, construction site waste, car wrecks, but also excess excavated soil (loose and solid rock excavated or removed during construction work). It is also "wild waste" if the waste has been covered with soil.

Depositing "wild garbage" is prohibited and constitutes an administrative offense. It may be subject to a fine.

If the perpetrator of the "wild garbage" can be identified, he or she will be charged for the disposal costs incurred.

As far as possible, citizens should provide the following information on:

  • the specific crime scene, the immediate surroundings (e.g. nature conservation area, water protection area, residential area) and the type (e.g. above-ground dumping, burial, burning) of illegal waste disposal
  • the quantity and type of waste disposed of (e.g. construction and demolition waste, asbestos, waste electrical equipment, motor vehicles, trailers, household waste, bulky waste, liquid, flammable, explosive, corrosive waste)
  • the perpetrator and the origin of the waste (household, industrial or commercial waste)
  • the owner of the land on which the waste is located
  • potential or already occurred environmental damage (penetration of pollutants into soil, groundwater, surface water, air)
  • the perception of odors

Official clearance and disposal orders issued to the obligated party are subject to a fee in accordance with the M-V Waste Cost Ordinance. The fee is based on the time spent by the authority in each case.

Verfahrensablauf

Please report "wild garbage" to the lower waste authority of your place of residence. They will take care of the disposal.

The responsible waste authority will examine the facts of the case and determine who is responsible under waste legislation and whether there is any further danger to people and the environment. If necessary, other specialized authorities are also involved in the procedure.

If the polluter of the illegal disposal can be identified, he will be ordered to remove the waste and to hand it over to the public waste disposal authority or to dispose of it properly. Official transfer and disposal orders can also be issued to the owner of the property on which the waste is located. As a rule, the latter is the current owner of the waste.

If necessary, other specialized authorities may also take measures in individual cases to avert or eliminate dangers or disturbances to the environment.

Administrative offences shall be prosecuted by the competent waste authorities at their due discretion.

Property owners must in principle also take care of the removal of "wild garbage" on their own property, which has been deposited there unintentionally. They regularly become waste owners even without the corresponding will.

However, this does not apply to private owners of properties for which the general public has access and trespassing rights.

Depositing "wild garbage" is prohibited and constitutes an administrative offense. It may be subject to a fine.

Recycling and disposal waste from private households as well as disposal waste from other sources except private households must be handed over to the public waste management authority (in M-V counties and independent cities) so that it can arrange for its orderly disposal. For recyclable waste from other sources, the waste producers or waste owners themselves must ensure proper disposal.

A large number of disposal facilities exist in M-V to ensure proper disposal.

The disposal of waste must be carried out in a manner that is compatible with general welfare. Waste may therefore only be disposed of in designated facilities. This means that proper disposal does not take place if waste is deposited above ground, buried, burned or disposed of in any other way by the waste producer or waste owner. This regularly constitutes a misdemeanor and, if hazardous waste is involved, may even be a criminal offense in individual cases. Anyone who unlawfully disposes of waste in the open countryside is generally obliged to remove this waste again.

Subsequently, the obligated party has to hand over the waste to the public waste management authority if there is an obligation to hand over the waste or otherwise to a suitable waste management facility. If the obligated party is not known and there is no new owner for the waste, the waste must generally be removed and disposed of at the expense of the general public.
