Anyone wishing to carry out experiments on vertebrates requires the approval of the competent authority.

Anyone wishing to carry out experiments on vertebrate animals requires the approval of the competent authority.

Persons and institutions carrying out experiments on vertebrate animals are obliged to submit regular reports on the type and number of animals used in the experiments. The killing of vertebrates for scientific purposes is not considered animal testing.

If the requirements for approval are met, the applicant is entitled to be granted approval.

Animal experiments that are prescribed or required by law or ordered by the authorities are not subject to approval. However, these must be reported to the competent authority.

Authorization must be granted if

• the experiment is essential,
• the responsible head of the experimental project and his deputy have the necessary professional qualifications, in particular with regard to the supervision of the animal experiments, and there are no facts that give rise to concerns about their reliability,
• the necessary premises, equipment and other material resources are available,
• the personnel and organizational requirements for carrying out the animal experiments are met,
• an animal welfare officer is working on the premises and
• the conditions under which the animals are kept meet the necessary requirements.

Only in the case of vertebrates (and cephalopods) is an examination of the ethical justifiability of the project required in addition to the other requirements.

• Submission of the complete application as an original (signed paper form) and in electronic form (will be forwarded immediately to the Animal Testing Commission) to the competent authority
• The preparation of the non-technical project summary for the "Animal Test Info" database of the Federal Institute for Risk Assessment (BfR) by the applicant and the corresponding approval by the competent authority take place in a separate electronic procedure.
• Formal application review by the competent authority and documentation of the data on a QM form
• Confirmation of receipt with information on the completeness of the application (if necessary, additional requirements are raised by the authority); transmission of the assigned file number; notification of the expected official consultation date with the Animal Experiments Commission (meets every 4 weeks)
• Substantive application review - substantive review of the application by the competent authority/documentation on a QM form; initial official vote/discussion basis for consultation with the Animal Experiments Committee
• Consultation of the application with the Animal Experiments Committee/recording of the result of the consultation by the competent authority. Depending on the outcome of the consultation, the applicant receives an interim decision on the Commission's vote and must deal with any additional requirements raised. Approval is postponed. A final decision is made after the applicant has submitted plausible answers to the additional requirements.
• The competent authority is the sole decision-maker.
• The task of the Animal Testing Commission is to advise the authority in the decision-making process. If the Commission's vote is unanimously positive and no additional claims are raised, a decision on the approval is made immediately and the approval notice is immediately issued and sent to the applicant.
• If no decision has been made after two meetings of the Commission and the intervening exchange of information between the authority and the applicant, the applicant is invited to a hearing by the competent authority in order to reach a decision through a direct exchange of arguments.
• Approval decisions are limited in time, but can be extended a maximum of two times.

The processing time is approximately 40 working days from receipt of an application that meets the requirements. However, it should be noted that the processing time can usually take longer.

All animals that have a skeleton with a vertebral column are considered vertebrates.
Anyone wishing to carry out animal experiments on vertebrates requires a permit. The approval of this experimental project by the competent authority and must meet the following requirements:

• the person responsible for the activity demonstrates specialist knowledge and skills,
• the person responsible for the activity has the necessary reliability,
• suitable premises and facilities and
• competent personnel.

In addition, an animal welfare officer must be appointed.
