Within secondary schools, pupils (from grades 7 to 9) can move to another course or type of school. A change to the next higher year of the gymnasium course is possible if the annual certificate in the subjects German, mathematics and both foreign languages has a better grade average than 2.5 and the class conference agrees.
If a child is found to have special educational needs, the legal guardians decide whether their child will go to a support school or remain at primary or secondary schools. The school authority must object if the personnel or actual conditions are not met or if adequate support cannot be provided due to the general pedagogical conditions.
Pupils of the non-gymnasiaal course who have received at least the overall "satisfactory" predicate in the intermediate-maturity examination are entitled to move to the three-year upper secondary school.
At the request of the parent or guardian or the general education school, the special educational needs are determined by the responsible school authority. The basis for the decision is a special educational needs assessment. The parents or guardians are given comprehensive advice.
A change to a special school is made at the request of the parent or guardian. Joint instruction at the elementary school can take place if the spatial, material and personnel requirements for the necessary special educational measures are available. A decision on the personnel requirements is made by the responsible school authority. The school authority is responsible for the spatial and material requirements.
The transfer to another course of education from grade 7 onwards takes place on application by the parents or guardians. The receiving school and the sending school cooperate in the transition. The class conference of the sending school makes a recommendation as to whether successful participation can be expected in the case of a transition. This is accompanied by a counseling session with the parent or guardian. The receiving school facilitates the transition through appropriate support measures.
The individual case must also be examined in accordance with the regulations of the above-mentioned transfer ordinance in force at the time.
