If you want to access a property from a main road, you need an access road. A separate permit is required for this in order to have as little impact as possible on the flow of traffic.
If you want to create or change an access road, the competent authority will check
- whether you are allowed to do this at all and (if so)
- how you must design the access road.
Federal highways (e.g. B 105, B 96) are used for long-distance traffic. This should run as smoothly as possible. Turning off a road into an access road disrupts the flow of traffic. You must therefore meet certain requirements for access to a federal highway. How strict these are depends in particular on the specific location of the access road.
Where there are already access roads and buildings on the main road, further access roads are generally permitted ("public use"). However, you also need approval for work on the road there. This specifies how you must design the access road.
In all other cases, you must check carefully whether you are allowed to create or change the driveway at all ("special use"). A separate permit is also required to change the traffic on the access road.
If you wish to construct or modify a building over the access road, the building will be taken into account as part of the approval procedure for the access road. In this case, you may need two permits - one for the temporary construction (building site) and one for the permanent development.
Once it has been established that you are allowed to create (or change) your access road, you will be informed of how you must design your access road.
Your access road must not impair the function of the road. It must therefore meet special technical requirements (e.g. paving, reinforcement of existing facilities, specific location, culvert). Only in this way can you be sure that all components of the road (such as the edge of the road, drainage systems, trees, footpaths and cycle paths, etc.) remain functional.

You can submit the following documents, for example, to verify the information in the application or for detailed information: Site plan, detailed plan, cadastral extract, documents relating to the building structure (general site plan, building permit, exemption or cover sheet of the building permit).
If it is necessary to check exactly whether you are allowed to create or change the access road at all ("special use"), the access road can usually only be approved under the following conditions:
- There is no other adequate way to reach the property.
- A refusal would be unreasonably hard on the applicant.
- The access road is compatible with public interests (e.g. safety or ease of traffic, expansion plans, road construction design).
An access road to the federal highway can be the subject of a wide variety of procedures. Depending on the respective procedure and the associated responsibility, you will either receive a decision from the competent road construction authority or the road construction authority will comment on the project to another competent authority. In any case, however, the road construction authority will check whether and, if so, under what conditions the access road and, if applicable, the facility accessed via the access road are permissible from a road law perspective. Should further questions arise, the responsible road construction authority will contact you directly.
