The use of a digital recording equipment is mandatory for certain motor vehicles that were first placed on the market on or after 01.05.2006.
Drivers shall use driver cards for each day on which they drive from the time they take over the vehicle. Drivers must protect the driver cards appropriately and must not use soiled or damaged driver cards. The digital recording device records driving times and rest periods, makes manipulation to the detriment of general road safety more difficult and facilitates checks.
The driver card replaces the previous tachograph disk and stores the driving and rest times for at least 28 days. After that, the oldest data is overwritten. Each driver may only have one valid driver card. This is checked (nationally: central tachograph card register kept by the Federal Motor Transport Authority, internationally: TACHOnet (Recommendation 2010/19/EU)). The information on driving times and rest periods stored on the driver card is intended to protect both the driver as an employee and all road users from accidents.
- A valid EU driving license or proof of a valid driving license from a member state of the European Union or another state party to the Agreement on the European Economic Area that entitles the holder to drive vehicles for which driving and rest periods must be observed (possibly a certified translation),
- an international driving license, if applicable,
- proof of residence in Germany and address, such as identity card or passport in conjunction with a confirmation of registration,
- if no residence in Germany has been established, an EU work permit, visa, work and residence permit, if applicable,
- Proof of birth and surname, first names, date and place of birth and
- a 35 mm x 45 mm photograph against a light background showing a frontal view of the applicant without headgear
In duly justified exceptional cases, a temporary and non-renewable driver card valid for a maximum period of 185 days may be issued to a driver not normally resident in a Member State or in a State party to the European Agreement concerning the work of crews of vehicles engaged in international road transport (AETR), provided that this driver is in an employment relationship with a company established in Germany.
The applicant must have a main residence in Germany or provide proof of employment in Germany.
The driver card can only be issued to holders of a valid driving license in the form of an EU driving license. If no EU card driving license is yet available, this must be applied for at the same time as the driver card application. At least one of the following driving license categories must be proven: B, BE, C1, C1E, C, CE, D1, D1E, D or DE.
Administrative fees are charged for official acts in the processing of applications for driver cards. The facts subject to fees and the amount of the fees are based on the Driving Personnel Act - State Ordinance on Jurisdiction and Costs. This does not include costs due to expenses or fees charged by the Federal Motor Transport Authority. The amount of the fees and expenses can be obtained from the authority or office processing the application.
A new driver card can be applied for at the driver licensing authority responsible for the place of residence or stay due to the loss of an existing card.
A personal visit is required to apply for a driver card, as a signature is also required. With their signature, the applicant confirms the accuracy of their details, the spelling of the personal data and the content.
The application must be accompanied by the required documents. At the request of the authority or body issuing the replacement card, the holder of the driver card must provide an affidavit stating that he/she is unable to return the driver card issued to him/her and the reasons for this. When the replacement card is issued, the replaced card loses its validity. A recovered card must be returned to the issuing authority or body. If the remaining term of the card to be replaced is less than six months, the card must be renewed. Before issuing a (new) driver card, the competent authority or body shall check with the central driving license register, the central driver card register and the driver card registers of the other Member States of the European Union and the signatory states to the Agreement on the European Economic Area whether the driving license document presented is valid and whether the applicant has already been issued a driver card elsewhere. The replacement driver card will be sent by post. If a driver card is replaced, the period of validity corresponds to the period of validity of the replaced card.
If a driver card is lost, the cardholder must immediately inform the authority or body that issued the stolen card. The authority or body issuing the replacement card shall report the loss to the driver card register at the Federal Motor Transport Authority. The driver may continue driving without a driver card for a maximum period of 15 calendar days, or for a longer period if this is necessary for the vehicle to return to its location, provided that the driver can prove that it was impossible to present or use the driver card during this period.
Once the application and all necessary documents have been received by the competent authority, a replacement card will be issued within eight working days.
The driver card is valid for five years. In the event of loss or theft, the replacement of the card must be applied for within seven calendar days. Upon receipt of a reasoned application, the driver licensing authorities will arrange for a replacement card to be issued.
The driver card can be reapplied for at the earliest one month before expiry, but no later than five working days before expiry.
From the moment the loss or theft of the driver card is noticed, the driver must
- print out the details of the vehicle he is driving at the start of his journey and enter in the printout
- enter the details that identify the driver (name, driver card or license number) and affix his signature, and
- enter his driving times, the times for other work and his standby time, and
- at the end of his journey, print out the details of the times recorded by the tachograph, note the times not recorded by the tachograph during which he has carried out other work, been on standby or taken a rest break since the printout was made at the start of the journey, and enter on this document the details by which the driver can be identified (name, driver card number or driving license number) and affix his signature.
The affidavit can only be waived if a theft report is submitted. The driver card will be sent by post to a summonable address.
A driver card is a personal record of driving and work data of drivers in commercial passenger and freight transport. The loss or theft of the driver card must be reported to the issuing authority or body.
In Mecklenburg-Vorpommern, the district councils and mayors of the independent and large district towns are responsible for applying for a new driver's license. You can contact any police headquarters in Mecklenburg-Vorpommern to report a theft, as they carry out all police duties.
In Mecklenburg-Western Pomerania, the State Office for Health and Social Affairs, Occupational Health and Safety and Technical Safety - Trade Supervisory Office - is responsible for receiving and processing applications for the issue of a contractor or workshop card.
