If you have carried out all the necessary measures during the closure phase of the landfill or landfill section, you must apply to the competent authority for final closure to be established.

The competent authority must be notified immediately of the closure of a landfill.

Once the necessary measures for the construction of a surface sealing system and recultivation have been carried out, you apply to the competent authority for the final closure to be determined. This determination is made by means of an inspection of the individual landfill sections and the associated technical equipment.

The notification must be accompanied by documentation on the intended closure or recultivation of the landfill site and the surface sealing must be constructed on this basis. The decisions of the authorities pursuant to Section 40 KrWG are not subject to the procedural requirements that apply to the approval pursuant to Section 35 KrWG.

The documents and evidence required for the termination of aftercare, which must be submitted by the applicant to the competent authority as a minimum, result from the test criteria in accordance with Annex 5 No. 10 DepV.

• Proof that gas formation does not take place or has stopped to such an extent that no active degassing is required, any residual gases that escape are sufficiently oxidized and harmful effects on the environment due to gas migration can be ruled out. Sufficient methane oxidation of the residual gas must be demonstrated.
• Proof that subsidence has subsided to such an extent that settlement-related damage to the surface sealing system can be ruled out for the future. For this purpose, the settlement development over the last ten years must be evaluated.
• Proof that the surface sealing system is in a functional and stable condition that cannot be impaired by the current and planned use; it must be ensured that this is also guaranteed in the event of changes in use.
• Proof that the landfill as a whole is permanently stable.
• Proof that the maintenance of structural and technical facilities is no longer necessary; dismantling has been carried out if necessary.
• Proof that the leachate discharged into a surface water body without treatment complies with the concentration values of Annex 51 Section C Paragraph 1 and Section D Paragraph 1 of the Waste Water Ordinance.
• Proof that the leachate seeping into the subsoil does not cause the trigger thresholds to be exceeded in the groundwater measuring points specified in accordance with Section 12 (1) DepV and that there is no reason to fear that they will be exceeded in the future.
• If waste containing asbestos or waste containing other hazardous mineral fibers has been deposited at the landfill, proof must be provided that suitable measures have been taken to prevent people from coming into contact with this waste.

The prerequisite for the final closure of a landfill is that a state-of-the-art surface sealing system has been installed and approved by the competent waste authority.
A prerequisite for determining the completion of the aftercare of a landfill is that all necessary measures have been taken to avoid any impairment of the public welfare. This is regularly fulfilled if the documents required under point 8 are available with a positive result.

Fees are charged in accordance with the Waste Cost Ordinance MV. The fees are due with the order to carry out decommissioning measures, with the determination of the final decommissioning or the determination of the end of the aftercare phase.
