Do you want to construct, operate or significantly modify a wastewater treatment plant? Then this project is subject to approval under certain conditions.

The construction, operation and substantial modification of a wastewater treatment plant require a permit if

• there is an obligation to carry out an environmental impact assessment for the plant in accordance with the Environmental Impact Assessment Act or
• the plant treats waste water that
  a) originates from installations pursuant to § 3 of the Ordinance on Installations Requiring a Permit, the permit requirement of which does not extend to the waste water treatment plant pursuant to § 1 paragraph 2 of the Ordinance on Installations Requiring a Permit, and
  b) is not covered by Council Directive 91/271/EEC of 21 May 1991 concerning urban waste water treatment (OJ L 135, 30.5.1991, p. 40), as last amended by Regulation (EC) No. 1137/2008 (OJ L 311, 21.11.2008, p. 1), or

• the plant treats waste water that
  a) originates from a landfill within the meaning of Article 3(27) of the Closed Substance Cycle Waste Management Act with a capacity of at least 10 tons per day or with a total capacity of at least 25 000 tons, excluding landfills for inert waste, provided that the landfill permit does not extend to the facility, and
  (b) is not covered by Directive 91/271/EEC.

You must ask the licensing authority which documents are required for the specific event.

Wastewater facilities must be constructed, operated and maintained in such a way that the requirements for wastewater disposal are met. In addition, wastewater treatment plants within the meaning of Section 60 (3) sentence 1 numbers 2 and 3 of the Water Resources Act must be constructed, operated and maintained in accordance with the state of the art.
The permit must be refused if the aforementioned requirements or other public law regulations cannot be complied with, not even by means of ancillary provisions.

Permits for wastewater treatment plants are issued subject to a charge (fees, expenses).
The administrative fees are based on the Water Management Costs Ordinance M-V, tariff item 214 (EUR 250.00 to 30,000).

Application, processing of the application, decision

The processing time depends on the quality and scope of the applications and documents submitted.

None. Timely application prior to the construction, operation or significant modification of a wastewater treatment plant is required.
A decision on the application for a permit for wastewater treatment plants pursuant to Section 60 (3) sentence 1 numbers 2 and 3 of the Water Resources Act shall be made within seven months of receipt of the application and the documents to be submitted. The competent authority may extend the deadline if this is necessary due to the difficulty of the examination or for reasons attributable to the applicant.

Appeal, after unsuccessful appeal to the administrative court. The proceedings can only be conducted in German.

The construction, operation and significant modification of a wastewater treatment plant require a permit if there is an obligation to carry out an environmental impact assessment for the plant in accordance with the Environmental Impact Assessment Act or if the plant treats wastewater that meets certain criteria (see Section 60 (3) of the Federal Water Act No. 2 and 3).

In Mecklenburg-Vorpommern, the State Office for the Environment, Nature Conservation and Geology is responsible for the approval of wastewater treatment plants in accordance with § 60 Para. 3 of the Water Resources Act (WHG) in accordance with § 107 Para. 3 No. 3 of the Water Act of the State of M-V (LWaG).
