The notification must contain the name and abbreviation under which the party intends to participate in the election and must be signed personally and by hand by the authorized representatives responsible for the electoral area in accordance with its statutes. The written statutes and the written programme of the party's Land organization as well as proof of the democratic election of the Land executive committee must be attached to the notification; proof of party status pursuant to Section 2 Paragraph 1 Sentence 1 of the Political Parties Act should be attached.
Parties which, on the day of the invitation to submit nominations, have not been continuously represented in the Mecklenburg-Western Pomerania state parliament or in the German Bundestag since the last election by at least one member of parliament elected for them in Mecklenburg-Western Pomerania on the basis of their own nominations may only submit nominations if they have notified the state electoral administration in writing of their participation in the election by 6 p.m. on the 108th day before the election and their party status has been established by the state electoral committee.
Submission
- The party declares in writing that it will participate in the election and submits the required documents in full.
- The Land returning officer notes the date of receipt on each notification of participation and immediately checks whether it meets the requirements of the law (preliminary examination).
Correction of deficiencies
- If the provincial election management body identifies any deficiencies, it shall immediately notify the party executive committee and request it to rectify any remediable deficiencies in good time.
- After the decision of the state election committee on the determination of party status, any rectification of defects is excluded.
Examination and approval
- The Land electoral administration shall summon the parties that have notified their participation in the election to the meeting at which a decision is made on their recognition as a party for the election. It submits the notifications of participation to the State Electoral Committee and reports on the result of the preliminary examination.
- Before the resolution is passed, the parties involved shall be given the opportunity to make a statement.
- The state electoral committee makes a binding decision for all electoral bodies,
- which parties are represented in parliament,
- the parties for which the Federal Electoral Committee determined party status at the last election to the German Bundestag,
- which associations that have notified their participation are to be recognized as parties for the election.
Announcement
- Following the determination, the Land returning officer announces the decision of the Land electoral committee at the meeting and briefly states the reasons. The decision is made public.
The notification of participation must be received by the Land electoral authority by 6 p.m. on the 108th day before the election.
The Land electoral committee shall make a binding determination for all electoral bodies by the 94th day before the election at the latest,
- which parties have been continuously represented in the state parliament of Mecklenburg-Western Pomerania or in the German Bundestag since the last election on the basis of their own nominations on the day of the invitation to submit nominations with at least one deputy elected for them in Mecklenburg-Western Pomerania,
- which associations that have notified their participation are to be recognized as a party for the election.
