Referendum is the means of putting a bill from a referendum petition to a vote after it has been rejected by the state parliament.
If the Landtag does not adopt the bill of a successful referendum petition essentially unchanged within six months, a referendum shall be held. A bill is adopted by referendum if the majority of those voting, but at least a quarter of those eligible to vote, have approved it.
A referendum shall only be held if Parliament rejects a bill submitted by referendum petition or if it fails to meet the deadline under section 16(3) VaG. The referendum on the bill shall then take place within three to six months of the decision to reject it or the expiry of the deadline.
The referendum shall be held no earlier than three months and no later than six months after the decision to reject the bill or the expiry of the deadline. The state government shall set the day of the referendum on a Sunday or public holiday and shall announce it in the official gazette for Mecklenburg-Western Pomerania together with the subject matter of the referendum, which shall include, in addition to an explanation of the previous and further procedure, the draft bill with reasons. The announcement enables the state government and the state parliament to present their views on the draft law in a concise and factual form.
The referendum is held in the municipalities. A register of voters shall be drawn up on the eligibility to vote.
Voting shall take place between 8:00 a.m. and 6:00 p.m. in a room accessible to the public, which shall be such as to preserve the secrecy of the ballot. The state election administration may, if special reasons so require, extend the voting time.
Voting shall be general, direct, free, equal and secret. The voters shall indicate by a cross on the ballot paper whether they wish to answer the question posed with "yes" or "no" or which of the bills, the contents of which are incompatible, they wish to vote for. The content of the question shall be determined by the state election administration.
A bill shall be adopted by referendum if the majority of those who cast their votes, but at least a quarter of those entitled to vote, have approved it. If the number of valid yes and no votes is equal, the bill is rejected. In the case of a constitutional amendment, two-thirds of all those voting and at least half of all those entitled to vote must have voted in favor. The result of the referendum shall be determined by the Land Electoral Committee.
The referendum shall be held at the earliest three months and at the latest six months after the decision to reject the referendum petition or after the six-month period has expired without results.
