Have you applied for a permit for an installation that requires approval? If so, you can also apply to the competent authority for permission to begin construction of the facility ahead of schedule.

The competent authority can revoke the permit at any time. In addition, the approval may be subject to conditions or be granted conditionally if you still have to meet certain requirements. The conditions are intended to ensure that the installation can be dismantled if it is not approved. To this end, the competent authority may require you to provide security. Collateral can be, for example, the deposit of money or securities as well as guarantees.

• The competent authority must be able to adequately assess the impact of the planned installation from the application and the required documents.
• Your application must demonstrate a legitimate interest in the early start.
• As the applicant, you must undertake to compensate for all damage caused by the premature construction up to the time of the decision and, if the project is not approved, to restore it to its previous state.

Fees are charged for the official act. The amount is primarily based on the installation costs of the facility or the administrative costs. Further details are regulated by the Immission Control Costs Ordinance M-V.

If you wish to apply to the competent authority for a partial permit for an installation requiring a permit, you must first submit the application documents in full.

You can do this in writing or electronically. The competent authority will confirm receipt of the application in writing or electronically, check it for completeness and involve other specialist authorities if necessary.

If necessary, the authority will request further documents.

You must submit the application before you start building the system.

If you wish to obtain approval for significant changes to an installation requiring approval, the competent authority can also provisionally approve the operation of the installation if the change serves to ensure the lawful construction or operation of the installation.
