At least two months before erecting an aviation obstacle for which no building permit is required, apply for an aviation permit from the relevant aviation authority.
If you want to erect installations, trees or equipment, for example a crane, the safety of air traffic may be at risk. Deepening the ground may also count as a hazard under certain circumstances. Therefore, under certain conditions, you will need a permit from the relevant aviation authority. In the case of structures that require approval or do not require approval, this approval is granted as part of the building permit. For ground excavations, structures or the installation of equipment or trees for which you do not require a building permit, you apply directly to the relevant aviation authority. Depending on the federal state, you can submit the application in writing or online.
If you already have planning permission for your project, additional approval from the aviation authority is not necessary.
A hazard to air traffic arises primarily in the vicinity of airfields, airports or landing sites for helicopters. The height of your building project therefore also depends on its proximity to such a location.
In the construction protection area of large airports (15 km radius in the approach sectors or 6 km radius otherwise), the height limits for the approval requirement depend on the height of the obstacle and the height of the terrain.
When approving an airfield, the aviation authority may determine that its approval is required for a construction permit in the following cases:
- within a radius of 1.5 kilometers of an airfield for all construction projects
- for structures that are 25 meters higher than the airfield and are located within a radius of 4 kilometers of the airfield.
This area is called the restricted construction protection area. Very high obstacles or obstacles on elevated ground may also require approval outside the restricted construction protection area. The responsible aviation authority will provide you with information on the approval requirement for your project.
Submit the application at least four weeks before the start of the project. Specify the type of obstacle, the location and the height in meters above ground and in meters above sea level of the top of the obstacle. Also state the date of installation and, in the case of temporary obstacles, the duration until when the obstacle will be in place.

- Site plan or topographical map at a scale of 1:10,000 or 1:25,000 showing the location and extent of the obstacle, e.g. crane location and boom width

- Location and height of the obstacle
- if no danger to aviation is to be expected
- if necessary, subject to conditions, e.g. for marking
- Find out about the approval requirement for your project, for example from the relevant aviation authority.
- Download the form online or use the online service directly.
- Complete the form and add the necessary supporting documents.
- Submit the application with the other documents to the relevant aviation authority.
- You will then receive the required permit by post or via the online service or, if applicable, a notification that your application has been rejected.
The aviation authority informs owners of affected properties about the new designation of construction protection areas at airfields.
