Would you like to operate a prostitution business (prostitution establishment, prostitution agency, prostitution vehicle or prostitution event)? You need a permit for this.

If you want to run a prostitution business, you need a permit from the competent authority. A prostitution business is a business in which services in connection with the provision of sexual services by at least one other person are offered on a commercial basis or premises are provided for this purpose.

A permit is required by any person who

• offers a prostitution establishment such as a building, individual rooms or other fixed facilities for the provision of sexual services for use (e.g. as a brothel, walk-in brothel, atelier),
• provides a prostitution vehicle for the provision of sexual services (e.g. bus, camper van, caravan, boat),
• organizes or conducts a prostitution event for an open circle of participants at which sexual services are offered for payment by at least one of the persons directly present (e.g. public porn shoot) or
• operates a prostitution agency, i.e. arranges for at least one other person to provide sexual services outside of the operator's prostitution establishments (e.g. call boy/call girl agency, escort agency). This also applies if it is only apparent from the circumstances that the procured services also include sexual acts.

The permit may be issued for a limited period of time and be subject to ancillary provisions (conditions). The permit for the provision of a prostitution vehicle must be limited to a maximum of three years and can be extended upon application.

Anyone wishing to operate their prostitution business through a deputy also requires a deputy permit.

Please note that, in addition to the permit requirement for the prostitution business, there are other permit or notification requirements under other regulations, in particular under the provisions of restaurant, trade, building, water or immission control law.

Sole proprietorship (natural person)

• Identity card, passport, electronic residence permit if applicable
• Operating concept
• Certificate of good conduct for submission to an authority according to document type "0", or European certificate of good conduct (to be applied for at the respective municipality of residence)

Companies (legal entities) e.g. GmbH

• Current excerpt from the commercial register / register of cooperatives
• Operating concept
• Identity card, passport, electronic residence permit for the legal representative(s) if applicable

• Certificate of good conduct for submission to an authority according to document type "0" for the legal representative(s), or European certificate of good conduct (to be applied for at the respective municipality of residence)

For prostitution vehicle license additionally:

• Operating license (registration certificate part I and part II)

• Age of majority
  • The applicant must have reached the age of 18.

• Personal reliability
  • Anyone wishing to operate a prostitution business must undergo a reliability check by the competent authority.

• Inprostitution establishments, it must at least be ensured that the rooms used for sexual services
  • are not visible from the outside,
  • have an appropriate emergency call system and
  • the doors can be opened from the inside at any time and
  • are not intended for use as living or sleeping quarters.

• Prostitution establishments must also:
  • have adequate sanitary facilities,
  • suitable recreation and break rooms and
  • have individually lockable storage facilities for personal belongings.

• Prostitution vehicles must
  • have a sufficiently large interior and
  • adequate interior fittings and
  • have adequate sanitary facilities,
  • have a valid operating license and
  • be in a technically operational condition.
  • It must be possible to open the doors from the inside at all times and
  • help must be available at all times via technical precautions.

• The minimum requirements for prostitution establishments apply accordingly to the roomsused for prostitution events.

Once you have submitted the application and all documents are complete, the competent authority will check whether you meet all the requirements for the permit you have applied for.

If you meet all the requirements, you will receive the permit.

You may only commence the prostitution business once you have received the permit.

Please note that once a prostitution business has been granted a permit, there are additional notification obligations in the cases of prostitution events and prostitution vehicles.

If the documents are complete, the application will be processed promptly.

You must have a corresponding permit before you start operating. It is therefore necessary to apply in good time.

If you wish to employ persons who will take on a deputy, management or supervisory function as well as the observance of domiciliary rights, admission control or security, they must also be notified to the competent authority before commencing work. These functions are subject to a background check.

The competent authority has extensive monitoring rights. Failure to comply with the licensing requirement can be punished accordingly.

Please note that in addition to the licensing requirement for the prostitution trade, there are other licensing or notification requirements under other regulations, in particular under the provisions of restaurant, trade, building, water or immission control law. A permit for the special use of public road areas may also be required.
