The removal, treatment and processing of wild plants and mushrooms requires an official permit if it is carried out commercially.
The commercial removal, treatment or processing of wild plants requires the approval of the authority responsible for nature conservation and landscape management, without prejudice to the rights of the owners and other authorized users. Permission must be granted if the population of the species in question is not endangered at the place of removal and the ecosystem is not significantly impaired. The removal must be carried out carefully. When deciding on removals for the purposes of regional seed production, the beneficial effects on the objectives of nature conservation and landscape management must be taken into account.
In this context, commercial means any removal and processing that exceeds the scope of the use specified in Section 39 para. 3 BNatSchG (careful removal in small quantities for personal use).
A derogation decision from the prohibition in Section 44 para. 1 no. 4 BNatSchG is also required for the removal of specially or particularly and strictly protected plants. The locally competent lower nature conservation authority is responsible for this decision. This authority is also responsible for deciding whether to grant a derogation from the prohibition on any impairment of protected biotopes or protected areas associated with the removal.
